The ICT sector is a driving force for the economy as a whole, for social and cultural enrichment, as well as for national development.</td><td>تعد حكومه المملكه العربيه السعوديه اتاحه الاتصالات وتقنيه المعلومات لجميع فيات المجتمع عنصر اساسي في استراتيجيه المملكه التنمويه. ويعد قطاع الاتصالات وتقنيه المعلومات قوه داعمه للاقتصاد الوطني بصفه عامه, ومساهاما في التنميه الاجتماعيه والثقافيه، اضافه الي مهمته في التنميه الوطنيه.</td></tr><tr><td>While significant progress has been made in the expansion and liberalization of the ICT sector, more should be done to bring the benefits of ICTS to all populations of the Kingdom of Saudi Arabia (the Kingdom). To achieve this, the Ministry of Communications and Information Technology (the Ministry) has approved this Universal Access and Universal Service Policy this Policy) which sets out the basis, principles and conditions relating to the provision of universal service and universal access.</td><td>وعلي الرغم من احراز تقدم كبير في تطوير وتحرير قطاع الاتصالات وتقنيه المعلومات، الا انه يتعين بذل مزيد من الجهود لتعميم فوالده علي جميع "سكان المملكه العربيه السعوديه" (المملكه). والتحقيق هذا الهدف، فقد وافقت وزاره الاتصالات وتقنيه المعلومات (الوزاره) علي قواعد واسس وشروط الخدمه الشامله وحق الاستخدام الشامل (سياسه الخدمه الشامله وحق الاستخدام الشامل). "universal service" implies that 100% of a population are reasonably able to subscribe to and use a defined ICT service at a defined quality on an individual or household basis.</td></tr><tr><td>2.0 Policy Vision and Objectives</td></tr><tr><td>The vision: to achieve the following, through the expansion of universal access and universal service:</td></tr><tr><td>• To promote greater social equity and inclusion." To contribute to national economic, social, and cultural development." The objectives:</td></tr><tr><td>• Achieving universal access to Internet service within a period of no more than five years." Achieving universal service for Internet service within a period of no more than seven years." The periods specified above shall commence on the date the Universal Service Fund ("USF") becomes operational, as described in this Policy.</td></tr></table> 3 <table><tr><td>The USF shall define voice service and Internet service for purposes of the above objectives. The USF shall be used to provide financing (i.e. subsidies) to compensate USF Service Providers.</td><td>تكون ايه المنافسه في مشاريع الصندوق هي الاليه الوحيده التي سوف تتلقي دعما ماليا من الصندوق. وسوف يتم استخدام الصندوق لتوفير التمويل المالي (التعويض المالي) لمقدمي خدمه مشاريع الصندوق.</td></tr><tr><td>4.0 Scope of the USF</td><td>نطاق عمل الصندوق ٤،</td></tr><tr><td>for each defined ICT service, the scope of the USF's activities for the promotion of universal access or universal service shall take into account the following geographic areas :</td><td>ان مجال عمل الصندوق هو تقدمي الخدمه الشامله وحق الاستخدام الشامل لخدمه محدده من خدمات الاتصالات وتقنيه المعلومات، اخدا في الاعتبار المناطق الجغرافيه التاليه:</td></tr><tr><td>• Served zones: Geographic areas where universal access or universal service is currently available.</td><td>المناطق المشموله بالخدمه: في المناطق الجغرافيه التي تتوفر بها حاليا لخدمه الشامله وحق الاستخدام الشامل.</td></tr><tr><td>• Commercially profitable underserved zones: Geographic areas where universal access or universal service is not currently available but where provision of such access or service is estimated by the USF to be commercially profitable under current and anticipated market conditions.</td><td>المناطق المربحه تجاريا ولا تتوفر فيها المطلوبه: في المناطق الجغرافيه الشامله، وحق الاستخدام الشامل حاليا، الا ان الصندوق يري بان تتوفر تلك الحدمات لها في ظل ظروف السوق الحاليه والمتوقعه: سيكون مربكا تجاريا.</td></tr><tr><td>• Commercially unprofitable underserved zones: The remaining geographic areas in the Kingdom that are not included in any of the other zones described above.</td><td>المناطق غير المربحه تجاريا ولا تتوفر فيها الحدمات المطلوبه: في بقيه المناطق الجغرافيه في المملكه التي لا تشملها اي منطقه من المناطق الاخري الموضحه ايضا.</td></tr><tr><td>The USF shall undertake studies to identify the geographic areas of the Kingdom that fall under each of the zones described above.</td><td>يقوم الصندوق باجراء دراسات للتعرف علي المناطق الجغرافيه بال المملكه التي تندرج تحت كل منطقه من المناطق الموضحه ايضا.</td></tr></table> 5 <table><tr><td>The USF shall focus exclusively on financing new networks and/or services to provide universal access or universal service to geographic areas that are in the commercially unprofitable underserved zones. The USF shall not provide any financing for geographic areas that are in the other zones, or for networks and/or services that are provided pursuant to either: (i) a roll-out obligation included as a license condition for one or more service provider (s), or (ii) a designation of one or more service provider (s) by the Commission as a universal service provider under the Telecommunications Bylaw the "Bylaw").</td><td>سوف يقتصر الصندوق بشكل اساسي علي تمويل الشبكات (و/او الخدمات) الجديده لتوفير الخدمه الشامله، وحق الاستخدام الشامل، للمناطق الجغرافيه التي توقع في المناطق غير المربحه تجاريا، ولا تتوفر فيها الخدمات المطلوبه، كما ان الصندوق لن يقوم بالt穆ولي للمناطق الجغرافيه الاخري، او للشبكات (و/او الخدمات) التي يتم توفيرها بموجب: (1) التزامات نشر الشبكه والخدمات وفق التراخيص الصادره لمقدم خدمه واحد او اكثر، او (2) تعيين مقدم خدمه او اكثر بوصفه "مقدم خدمه شامله" بموجب اللايحه التنفيذيه لنظام الاتصالات اللايحه (الTNFID). <table><tr><td>5.0 USF Programs and Projects</td><td>برامج ومشاريع الصندوق 0,</td></tr><tr><td>Pursuant to this Policy, the USF shall prepare Programs and Projects in accordance with the following:</td><td>بموجب هذه السياسه، سوف يقوم الصندوق ابعاد البرامج والمشاريع وفق ما يلي:</td></tr><tr><td>• Programs: These are macro-scale USF initiatives aimed at achieving one or more of the objectives of this Policy, typically over the course of several years. USF Programs shall define specific targets in terms of specific networks and/or services to be implemented in stages based on funding availability, the priority established by the USF for the objectives of this Policy and other criteria as determined by the USF.</td><td>البرامج: هي المبادرات الرييسيه التي يقوم بها الصندوق لتحقيق هدف او اكثر من اهداف هذه السياسه. وتضمن برامج الصندوق خلال السنوات القادمه، تحديد اهداف معينه لتنفيذ شبكات (و/او خدمات) محدده علي مراحل يتوقف تنفيذها علي توفر التمويل، وكذلك تحديد الاولويه والمعاير الاخري التي يضعها الصندوق لتحقيق اهداف هذه السياسه.</td></tr><tr><td>• Projects: These are the specific micro-scale implementation activities related to each USF Program. Each USF Project will</td><td>المشروعات: هي انشطه فرعيه محدده لاي برنامج من برامج الصندوق. وسوف يقوم الصندوق اعداد تخطيط تفصيلي وتحليل ماليه</td></tr></table> 6 <table><tr><td>involve detailed planning, financial and other analysis by the USF. One or more Projects may be implemented at the same time under a given Program. For example, each such Project may cover a different geographic area, population and/or service.</td><td>وغير ذلك لكل مشروع من هذه المشاريع. ويمكن تنفيذ مشروع واحد او اكثر في الوقت نفسه ضمن برنامج محمد. علي سبيل المثال, يمكن ان يغطي المشروع اي منطقه جغرافيا او سكانيه او خدمه محدده.</td></tr><tr><td>6.0 USF Creation, Governance and Administration</td><td>انشاء الصندوق وادارته ٦.</td></tr><tr><td>The Commission shall issue a decision to establish the USF (the "Decision") consistent with this Policy. The Commission shall issue the Decision within a period of 6 months after the Ministry approves this Policy. The Decision shall further specify the legal and procedural nature of the USF and other necessary ancillary matters, including rules for managing the accounts of the USF.</td><td>" تقوم الهييه اصدار قرا بانشاء الصندوق ("القرار") بما يTfق مع هذه السياسه. ويجب ان تصدر الهييه هذا القرار خلال (1) سته اشهر من موافقه الوازاه علي هذه السياسه. علي ان تحدد من خلاله الطييههالنظاميه والاجراييه للصندوق وغير ذلك من الامور اللازمه لعمل الصندوق, بما في ذلك قواعد اداره حساباته.</td></tr><tr><td>In addition to the Decision, the Commission shall, in accordance with the Commission statutes, prepare all other measures it deems necessary to implement this Policy (the Execution Measures"), including: (i) preparation and issuance of decisions, guidelines, mechanisms or any other instruments, and (ii) amendment of any existing mechanisms or instruments including the Bylaw.</td><td>بالاضافه الي اصدار القرار، تقوم الهييه وفقا لانظمتها بالعمل علي اصدار جميع المعايير التي "تراها ضروريه لتنفيذ هذه السياسه ("معايير التنفيذ") متضمنه (I) اعداد واصدار اي قرارات او ارشادات او اليات او اي مستندات اخري (I) تعديل اي اليه قايمه او مستند قايم بما فيها اللثه التنفيذيه.</td></tr><tr><td>The Decision and the Execution Measures shall comply with all of the following general principles:</td><td>ويجب ان يتوافق القرار ومعايير التنفيذ مع المبادي: العامه التاليه:</td></tr><tr><td>6.1 Nature of the USF</td><td>طبيعه الصندوق 7,1</td></tr><tr><td>The primary goal of the USF shall be to implement this Policy.</td><td>الهدف الاساسي للصندوق هو تنفيذ هذه السياسه.</td></tr></table> 7 <table><tr><td>The USF shall give effect to this Policy in a transparent, non-discriminatory and competitively neutral manner.</td><td>يقوم الصندوق بتنفيذ هذه السياسه بشفافيه.وعدم تمييز,})(في اجواء تنافسيه وحياديه.</td></tr><tr><td>The USF shall be independent and separate from all service providers, and shall not itself become a service provider.</td><td>يكون الصندوق مستقلا ومنفصل عن جميع مقدمي الخدمه, ولا يجوز له ان يكون مقدمخدمه.</td></tr><tr><td>6.2 USF Structure</td><td>هيكل الصندوق 7,1</td></tr><tr><td>The USF shall be established as a part of the Commission.</td><td>يتم تاسيس الصندوق بصفه جزاء من الهييه.</td></tr><tr><td>The USF shall consist of two bodies: The Board of the Commission (the "Board") and the USF administration ("the Administration").</td><td>يتكون الصندوق من كيانين:مجلس اداره الهييه ("المجلس") واداره الصندوق.</td></tr><tr><td>The Board shall be the governing body of the USF and shall supervise and provide direction to the Administration.</td><td>المجلس هو السلطه العليا للصندوق. و اصدار اداره، علي يتوالي الاشراف.</td></tr><tr><td>The Administration shall be responsible for the day-to-day operation and administration of the USF.</td><td>تتولي اداره الصندوق بالاعمال اليوميه للصندوق واداره.</td></tr><tr><td>The Administration shall be led by an individual administrator (the Administrator). The Administrator shall report directly to the Governor of the Commission and shall be appointed by the Board in accordance with the Decision and the Execution Measures.</td><td>يتولي اداره الصندوق. Where the USF Report recommends changes to the USF structure, procedures or related matters, the Commission may issue a decision to implement one or more of the changes.</td><td>يقوم المجلس، من وقت لاخر باعتماد خطه تشغيل الصندوق لتنفيذ البرامج والESMARIE المحدده الوارده بالخطه "خطه التشغيل".</td></tr><tr><td>The Board shall, from time to time, approve a plan to direct the operations of the USF in implementing the specific Programs and Projects included in the plan (the "Operating Plan")</td><td>تقوم اداره الصندوق، من وقت لاخر، باعتماد خطه تشغيل الصندوق.</td></tr><tr><td>The Administration shall, from time to time, prepare an Operating Plan for approval of the Board.</td><td>تقوم اداره الصندوق، من وقت لاخر، باعتماد خطه التشغيل لاعتمادها من قبل المجلس.</td></tr></table> 9 <table><tr><td>■ The Operating Plan shall include the USF's administrative costs as estimated by the Administration. Such costs shall be financed from the accounts of the USF.</td><td>■ تتضمن خطه التشغيل التكاليف الاداريه للصندوق كما تفدرها ادارته. يجري تمويل هذه التكالفه من حساباته.</td></tr><tr><td>■ The Operating Plan shall also include one or more Programs and Projects.</td><td>■ تتضمن خطه التشغيل برنامج ومشروع واحدا او اكثر.</td></tr><tr><td>■ For the purposes of this Policy, the USF shall become operational on the date the first Operating Plan is approved by the Board.</td><td>■ يبدا عمل الصندوق ابتداء من تاريخ اعتتماد المجلس الاول خطه تشغيليه.</td></tr><tr><td>■ Projects may be designed by the Administration or may be proposed by other persons for consideration of the Administration.</td><td>■ يمكن لاداره الصندوق تحديد المشاريع. كما يمكن اقتراحها من اشخاص اخرين، لتعرض بعد ذلك علي اداره الصندوق.</td></tr><tr><td>■ All Projects shall be awarded by the USF based on a competitive selection process pursuant to the Competitive USP mechanism.</td><td>■ يقوم الصندوق بترسيه جميع مشاريعه عن طريق اليه المنافسه في مشاريع الصندوق.</td></tr><tr><td>6.4 Financing of the USF</td><td>■ تمويل الصندوق 7,٤</td></tr><tr><td>■ The USF shall be financed primarily by the monies collected through a new fee established pursuant to the Decision (the "USF Fee") and deposited into the accounts of the USF. The amount of subsidy to be paid shall be determined by the USF as part of the competitive selection process.</td><td>يتمثل التمويل المالي المقدم من الصندوق • لمقدم خدمه مشاريع الصندوق في تمويل مالي يمنح مره واحده. وسيتم تحديد مبلغ التمويل الممنوح من قبل الصندوق بصفه جزاء من عمليه المنافسه في مشاريعه.</td></tr><tr><td>• The maximum amount of the one-time subsidy available for each Project shall be proposed by the Administration and included in the Operational Plan to be approved by the Board. Such a review shall be done at least once every two years from the date the USF becomes operational. In undertaking such a review, the Commission shall give consideration to: (i) economic, social, cultural and technological developments, (ii) the expansion of universal access and universal service in the Kingdom, and (iii) any other matters the Commission considers appropriate.
