VISION www.shed.com KINGDOM OF SAUDI ARABIA ٢٩/٤/١٢٤ الترجيم اللجنه الوطنيه لکود البناء السعودي Saudi Building Code National Committee كود البناء السعودي Saudi Building Code قرار وزاري ان وزير التجاره والاستثمار رييس مجلس اداره الهييه، وبناء علي الصلاحيات المحوله له، وبعد الاطلاع علي نظام تطبيق كود البناء السعودي الصادر بموجب المرسوم الملكي رقم (٢٣) وتاريخ ٢٤١/٤/٢٦ وبناء علي الماده الخاصه عشر من نظام تطبيق كود البناء السعودي. يعتمد تنفيذ ما يلي: اولا: العمل باللحه تصنيف مخالفات كود البناء السعودي بالصيغه المرفقه بهذا القرار. فانيا: تنشر هذه الالخنه في الجريده الرسميه ويعمل بها اعتبارا من تاريخ نشرها. وزير التجاره والاستثمارات رييس مجلس اداره العينه د. ماجد بن عبد الله القصبي (٢) الجنه الوطنيه لکود البناء السعودي - ٢٢- اي الحسن السلمي - محمديه - ص.ب. ١٢٦٤ - الرياض ٢٠٠٠ هاتف: ١١ ٤٠٠٤٢٠٧ - فاكس - ١١ ٤٠٠٤٢٠٧ Saudi Building Code National Committee - 7722 Abi Hassan Salami - Muhammadiyah - P.O. No. (7) www.sbc.gov.sa VISION 23:30 KINDOM OF SAUDI ARABIA اللحنه الوطنيه لکود البناء السعودي Saudi Building Code National Committee كود البناء السعودي Saudi Building Code لانحه تصنيف مخالفات كود البناء السعودي الماده الاولي: يرجع في تعريف مفردات ومصطلحات هذه اللاتحه الي التعريفات الوارده في اللاتحه التنفيذيه لنظام تطبيق كود البناء السعودي. الماده الثانيه: يعتبر الاخلال باي من متطلبات الكود او نظامه او لوايحه مخالفه تستوجب الازالاه او التصحيح وتعرض مرتكبها للعقوبه بما تقرره لجنه النظر عند تحقيق مقتضهاها النظامي، ولا يعد ايقاع العقوبه بديلا عن الازاله او التصحيح. الماده الثالثه: يتم ضبط المخافات وتوثيقها من قبل مختصين مؤهلين في الكود تصدر بسميهم قرارات من جباهم الرسميه، وتعد محاضر الضبط وثيقه معتبره في البناات المخالفات وايقاع العقوبات. الماده الرابعه: عند اكتشاف مخالفه اثناء عمليه التفليس او الاشراف ولم يبادر المخالف في حينه بتداركها، اواتم تلقي بلاغ عنها فيتم اشعار مسؤول الضبط للوقوف عليها. الماده الخامسه: tتم عمليه الضبط وفق نموذج موحد تعده الجهه المختصه بالسواره، ويشتمل علي الاتي: ا- تاريخ الضبط ويومه وساعته. ب- اسم مالك المبني. ج- رقم الترخيص ونوعه. د- تصنيف المبيي ونوعه ومكانه. ه- نوع المخالفه ووصفها وموقعها من المبيي. No. (7) www.sbc.gov.sa VISION 23:30 KINDOM OF SAUDI ARABIA اللجنه الوطنيه لکود البناء السعودي Saudi Building Code National Committee كود البناء السعودي Saudi Building Code و- مرجع المخالفه في الكود ورقمها. - درجه خطوره المخالفه والضرر الناتج عنها. - تقدير مده تصحيح المخالفه او ازالتها. ط- اسم المخالف وافرادته وتوقيعه، والاشاره الي امتناعه حال ذلك. ي- توفيق المخالفات بالصور او ارفاقها ان امكن. ل- اسم وتوقيع مسؤول الضبط. ل- اي معلومات اخري تري الجبهه المختصه بالوزاره اضافتها. الماده السادسه: علي من تسند اليه مهمه ضبط مخالفات الكود تحري الدقه واستشعار المسؤوليه وانجاز عمليه دون تاخير وتسليم محاضر الضبط مرجعه في نفس اليوم او اليوم الذي يليه لقيها ومراجعها واعتمادها، وله في سبيل ذلك دخول المباني والمنشات والاطلاع علي المستندات والوثايق والمخططات. الماده السابعه: (1) عند ضبط مخالفه غير خطره تشعر الجهه ذات العلاقه المخالف بها بطرق الابلاغ المتبعه نظاما. وتطلب متنه ازالتها او تصحيحها بما يتفق مع الكود في المده المحدده في محضر الضبط. (٢) حال ازاله المخالفه او تصحيحها بشعر المخالف الجهه ذات العلاقه بذلك. (٣) اذا لم يزل المخالف المخالفه او يصححها خلال المده المحدده تحيل الجهه ذات العلاقه المخالفه الي لجنه النظر في المخالفات. الماده الثامنه: عند ضبط مخلفه خطره تقوم الجهه ذات العلاقه بالتالي: (1) اشعار المخالف بها بطرق الابلاغ المتبعه نظاما، وطلب ازالتها او تصحيها فورا بما يتفق مع الكود. ايقاف البناء او الجزء او القسم الذي يشكل خطوره او منع الاشغال او التشغيل او اخلاء المبني حتي يزيل المخالف المخالفه او يصحها. No. (7) www.sbc.gov.sa VISION الموارد المزجmid المزجmid المزجmid المزجmid المزجmid المزجmid المزجmid المزجmid المزجmid المزاجmid المزجmid المزجmid المزجmid المزجmid المزجmid المزجmid المزجmid المزجmid الم مزجmid الم مزجmid الم مزجmid الم مزجmid الم مزجmid الم مزجmid الم مزجmid الم مزجmid الم مزجmid اليمن VISION الموقعد لموالي الاولي KINGDOM OF SAUDI ARABIA المجنه الوطنيه لکود البناء السعودي Saudi Building Code National Committee كود البناء السعودي Saudi Building Code الماده التاسعه: اذا لم يبادر المخالف بازاره المخالفه الخطره او خلال الميله المحدده للمخالفات الاخري و كانت المخالفه تعيق او تعطل بصوره مباشره الانتفاع من الطرق او الخدمات العامه او تشكل خطوره علي السلامه او الصحه العامه او البينه او تشوه المظهر العام للمدينه فلنجهاز البدري بعد التنسيق مع الجهات المختصه ازالتها علي نفقه المخالف. الماده العاشره: اذا تم اكتشاف مخالفه خطره ولم يستدل علي المخالف ولا عنوانه فيعد مسؤول الضبط محضرا عن المخالفه، ويتم التحي والمناتبعه الدقيقه للبحث عن المخالف. اذا تعذر الوصول اليه يقوم الجباز البلدي بعد التنسيق مع الجهات المختصه باخلاء المبيي او منع الاشغال او ازاله المخالفه ان دعت الحاجه. وعند معرفه المخالف يحمل نفقات الازاله بالاضافه الي العقوبه المترتبه عليها. الماده الحاديه عشره: مع عدم الاخلال باي عقوبه اشد ينص عليها نظام اخري. تقوم لجنه النظر بقياع العقوبات المناسبه لكل مخالفه وفق الماده الثانيه عشره من النظام، وتراعي في ذلك الايس التياله: (1) درجه خطوره المخالفه واشراب الازواح او الاموال او بالضحه او بالنظام العام. (2) مساحه البناء و حجمه ووجه وكلفه انشايه واهميه موقعه. (٣) تناسب العقوبه مع المخالفه. (٤) الظروف المخففه والمشده المصاحبه لاتكاب المخالفه. (٥) مبادره المخالف بازاريه المخالفه او تصحيحها. (٦) تكرار المخالفه او تعددها. (٧) اقتران المخالفه بمحاوله عرقله عمليه الضبط او التفتيش او عدم التعاون مع المسؤولين. (٨) تعمد ارتكاب المخالفه. الماده الثانيه عشره: تستعين لجنه النظر بالعقوبات الوارده في جدول المخالفات والعقوبات الملحق، وتقويم الجبهه المختصه بالوزاره بعد سنه من تطبيق النظام بمراجعه الجدول في ضوء قرارات لجان النظر وواقع العمل الفعلي الصفحه ٣ من ١٠ Saudi Building Code National Committee - 7722 Abi Hassan Salami - Muhammadiyah - P.O. No. (7) www.sbc.gov.sa VISION KINGDOM OF SAUDI ARABIA اللجنه الوطنيه لکود البناء السعودي Saudi Building Code National Committee كود البناء السعودي Saudi Building Code ودراسته وبعته الي اللجنه الوطنيه لاقتراح التعديلات اللازمه عليه ورفعه لاعتماد تطبيقه بشكل ملزم من وزير التجاره والاستثمار رييس مجلس اداره الهييه. الماده الثالثه عشره: اذا كان في ازاله المخالفه ضرر علي سلامه المبني فيتم تصحيحها بما يحقق سلامه وفق الحلول الهندسيه المكنه، علي ان يتم احضار تقرير من مكتب هندسي معتمد ومؤهل من الوزاره يثبت سلامه المبني وعدم امكانيه الازاله. الماده الرابعه عشره: يتم تحصيل الغراامات وفقا للاجراءات المتبعه في تحصيل الاموال العامه. الماده الخامسه عشره: تعتبر قرارات لجنه النظر نافذه بصدورها، وبلغ المخالف بها بطرق الابلعه المتبعه نظاما. الماده السادسه عشره: يجوز التظلم من قرارات لجان النظر امام المحاكم الاداريه بديوان المظالم خلال ستين يوما من تاريخ العلم بها الماده السابعه عشره: حال ايقاع اي عقوبه علي المكتب الاستشاريه او الهندسيه او الفنيه او المقاولين بسبب مخالفه الكود. يقوم الجهاز البلدي اشعار الجهات المرجعيه لمم بالخالفات والعقوبات المقرره عليهم. الماده الثامنه عشره: يعمل بهذه اللاتحه اعتبارا من تاريخ نشرها في الجريده الرسميه. الصفحه ٤ من ١ q (٧) اللجنه الوطنيه لکود البناء السعودي ٢٧٧٢- ابي الحسن السلمي - المحمديه - ص.ب. ١٢٧٧- الرياض ٢٠٠٠ - هاتف: ١١٤٠٥٤٢٠٧ - رقم المبني: (٧) Saudi Building Code National Committee - 7722 Abi Hassan Salami - Muhammadiyah - P.O.
