# احكام عامه علي الجداول المرفقه بنظام مكافحه المخدرات والمؤثرات العقليه

المعتمده بمحضر الاجتماع العاشر للجنه المشتركه بين وزاره الصحه والهييه العامه للغذاء والدواء المبني علي قرار وزير الصحه رقم ٨٣٣٩٣٦/١٤٤١ وتاريخ ١٤٤١/٠٦/١٦ه

## المواد المخدره:

اولا: الجدول الاول يشمل المواد المخدره وينقسم الي خمس فيات علي النحو التالي:
1. فيه (ا) تضم المواد المخدره المدرجه في الجدول الاول لاتفاقيه الامم المتحده لعام ١٩٦١م.
2. فيه (ب) تضم المواد المخدره المدرجه في الجدول الثاني لاتفاقيه الامم المتحده لعام ١٩٦١م.
3. فيه (ج) تضم المواد المخدره المدرجه في الجدول الثالث لاتفاقيه الامم المتحده لعام ١٩٦١م.
4. فيه (د) تضم المواد المخدره المدرجه في الجدول الرابع لاتفاقيه الامم المتحده لعام ١٩٦١م.
5. فيه (ه) تضم المواد المخدره المراقبه محليا بالمملكه.

ثانيا: الفيات (ا، ب، ج، د) في الجدول الاول المذكوره اعلاه تعرف بالقايمه الصفراء والتي تصدر عن الهييه الدوليه لمراقبه المخدرات.

ثالثا: فيه (د) من الجدول الاول، يحظر استيرادها او تصديرها او انتاجها او صنعها او استعمالها او الاتجار بها او توزيعها او وصفها او حيازتها باي وسيله كانت، ويقتصر استخدامها علي الابحاث الطبيه والعلميه فقط بعد اخذ موافقه قطاع الدواء في الهييه العامه للغذاء والدواء.

رابعا: المستحضرات الصيدلانيه التي لا تخضع لنظام مكافحه المخدرات والمؤثرات العقليه ويكون احد مكوناتها 8 ملجم كوديين فاقل وبشكل صيدلاني اقراص او كبسولات فقط، فانها تكون من الادويه التي تصرف بوصفه طبيه ولا تطبق عليها الاحكام الوارده في نظام مكافحه المخدرات والمؤثرات العقليه ولكن تطبق عليها الاحكام الوارده في نظام المنشات والمستحضرات الصيدلانيه ولايحته التنفيذيه.

الوارده في الفيه (ب) من الجدول الثاني، يحظر استيرادها او تصديرها او انتاجها او صنعها او استعمالها او الاتجار بها او توزيعها او وصفها او حيازتها باي وسيله كانت، ويقتصر استخدامها علي الابحاث الطبيه والعلميه فقط، بعد اخذ موافقه قطاع الدواء في الهييه العامه للغذاء والدواء.

خامسا: المؤثرات العقليه التاليه:
* EPHEDRINE.
* ETHANOL.
* NOREPHEDRINE.

الوارده في الفيه (ه) من الجدول الثاني اذا كانت علي شكل صيدلاني وللعلاج الطبي فانها تخضع للرقابه وتطبق عليها الاحكام الوارده في نظام مكافحه المخدرات والمؤثرات العقليه، اما المستحضرات الصيدلانيه التي يكون احد مكوناتها احدي هذه المواد فانها لا تخضع للرقابه ولا تطبق عليها الاحكام الوارده في نظام مكافحه المخدرات والمؤثرات العقليه، ولكن يطبق عليها نظام المنشات والمستحضرات الصيدلانيه ولايحته التنفيذيه.

وما عدا ذلك فتطبق عليها الاحكام الوارده في نظام استيراد المواد الكيمياييه وادارتها الصادر بقرار مجلس الوزراء الموقر رقم (١٤٣) وتاريخ ١٤٢٧/٦/١٤ه، والمصادق عليه بالمرسوم الملكي الكريم رقم (م/ ۳۸) وتاريخ ١٤٢٧/٦/١٦ه.

سادسا: المستحضرات الصيدلانيه التي تحتوي علي ماده مخدره ومؤثر عقلي تعامل كماده مخدره.

سابعا: تعامل المواد القياسيه التي تحتوي مواد مخدره او مؤثرات عقليه معامله الماده التي تحتويها.

ثامنا: كواشف المواد المخدره والمؤثرات العقليه، لا تخضع للرقابه ولا تطبق عليها الاحكام الوارده في نظام مكافحه المخدرات والمؤثرات العقليه، وتعامل معامله الكواشف العاديه ويكون فسحها عن طريق قطاع الاجهزه والمنتجات الطبيه في الهييه العامه للغذاء والدواء.

## المؤثرات العقليه:

اولا: الجدول الثاني يشمل المؤثرات العقليه وينقسم الي خمس فيات علي النحو التالي:
1. فيه (ا) تضم المؤثرات العقليه المدرجه في الجدول الاول لاتفاقيه الامم المتحده لعام ١٩٧١م.
2. فيه (ب) تضم المؤثرات العقليه المدرجه في الجدول الثاني لاتفاقيه الامم المتحده لعام ١٩٧١م.
3. فيه (ج) تضم المؤثرات العقليه المدرجه في الجدول الثالث لاتفاقيه الامم المتحده لعام ۱۹۷۱م.
4. فيه (د) تضم المؤثرات العقليه المدرجه في الجدول الرابع لاتفاقيه الامم المتحده لعام ۱۹۷۱م.
5. فيه (ه) تضم المؤثرات العقليه المراقبه محليا بالمملكه.

ثانيا: الفيات (ا، ب، ج، د) في الجدول الثاني المذكوره اعلاه تعرف بالقايمه الخضراء والتي تصدر عن الهييه الدوليه لمراقبه المخدرات.

* METHAQUALONE.
* SECOBARBITAL.

## السلايف الكيمياييه:

الجدول الثالث يشمل السلايف الكيمياييه وينقسم الي فيتين علي النحو التالي:
1. فيه (ا) تضم السلايف الكيمياييه المدرجه في الجدول الاول لاتفاقيه الامم المتحده لعام ١٩٨٨م.
2. فيه (ب) تضم السلايف الكيمياييه المدرجه في الجدول الثاني لاتفاقيه الامم المتحده لعام ١٩٨٨م.

## البذور والنباتات:

الجدول الرابع يشمل النباتات والبذور المحظوره واي جزء منها وفي جميع اطوار نموها وعلي اي شكل كانت او وجدت.

* For the calculation of estimates and statistics in accordance with the terms of the 1961 Convention. coca leaf preparations containing more than 0,1 per cent of cocaine and made direct from coca leaf should be considered to be coca leaf (preparations).
** Dextromethorphan ((+)-3-methoxy-N-methylmorphinan) and dextrorphan ((+)-3-hydroxy-N-methylmorphinan) are isomers specifically excluded from this Schedule.
*** For the calculation of estimates and statistics in accordance with the terms of the 1961 Convention. all preparations made direct from opium are considered to be opium (preparations). If the preparations are not made direct from opium itself but are obtained by a mixture of opium alkaloids (as is the case. for example. with pantopon. omnopon and papaveretum) they should be considered as morphine (preparations).
