Statute: The regulation establishing the Integrated Logistics Special Zone, issued under Royal Order No. (A/17), dated 01/02/1440H. • Governing Body: The General Authority of Civil Aviation (GACA). - Zone: The Integrated Logistics Special Zone at King Khalid International Airport or other logistics zones under GACA's supervision. - Mainland: The Kingdom of Saudi Arabia, excluding the Zone. - Operator: The entity responsible for managing the Zone's operations. - Regulation: Electronic Waste Management and Recycling in the Special Logistics Economic Zones Regulation and its subsequent guidelines. • Guideline: The technical guide and requirements for E-Waste management within the Zone. التنظيم: تنظيم المنطقه الخاصه للوجستيه المتكامله الصادر بالامر الملكي الكريم رقم (١/٧) وتاريخ 1440/02/01 الجهه المختصه: الهييه العامه للطيران المدني. المنطقه: المنطقه الخاصه للوجستيه المتكامله بمطار الملك خالد الدولي او المناطق اللوجستيه الاخري تحت اشراف الهييه العامه لطيران المدني. البلد الرييسي: اقليم المملكه العربيه السعوديه ماعدا المنطقه. الجبهه المضغله: هي الجبهه التي يسند لها تشغيل واداره اعمال المنطقه الخاصه اللوجستيه المتكامله. اللايحه: لانحه اداره النفايات الالكترونيه واعاده تدويرها في المناطق الخاصه اللوجستيه المتكامله وما يتعها من ادله. الدليل الارشادي: هو الدليل المتضمن المتطلبات الفنيه لاداره النفايات الالكترونيه داخل المنطقه الخاصه اللوجستيه المتكامله. 4 GACA الهنيه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] - Investment Regulation: Investment regulation issued by the Governing Body. - Customs Rules: The customs procedures regulation for the Zone, issued by the Governing Body. • Zone Activities: The activities specified in Article (6) of the Statute. - Basel Convention: The international treaty on the control of transboundary movements of hazardous wastes and their disposal. - WEEE Standards: European standards ensuring sustainable management of electrical and electronic waste through collection, recycling, and environmentally safe processing. - WEEE Labex: A set of European standards aimed at ensuring that electrical and electronic waste is managed in the collection, treatment and recycling of e-waste in a sustainable manner and in compliance with environmental legislation. - EU Waste Framework Directive: A document defining waste and key management terms like disposal, recycling, and reuse to ensure a uniform and sustainable application of environmental legislation in the EU. لانحه الاستثمار بالمنطقه الخاصه اللوجستيه المتكامله الصادره من الجبه المختصه. القواعد الجمركيه: لانحه قواعد الاجراات الجمركيه بالمنطقه الخاصه اللوجستيه المتكامله الصادره من الجبه المختصه. انشطه المنطقه: الانشطه المحدده في الماده (السادسه من (التنظيم). اتفاقيه بازل: المعاهده الدوليه بشان التحكم في نقل النفايات الخطره والتخلص منها عبر الحدود. المعايير الاوروبيه (WEEE Standards) : مجموعه معايير اوروبيه تهد الي ضمان اداره النفايات الكهرباييه والالكترونيه في عمليات الجمع والمعالجه واعاده تدوير النفايات الالكترونيه بطريه مستدامه و متوافقه مع التشريعات البيييه. معاييرووي لابكس (WEEE Labex) : مجموعه معايير اوروبيه تهدف الي ضمان اداره النفايات الكهرباييه والالكترونيه في عمليات الجمع والمعالجه واعاده تدوير النفايات الالكترونيه بطريقه مستدامه و متوافقه مع التشريعات البيييه. توجيه الاطار الاوروبي للنفايات: مجموعه من القوانين التي وضعها الاتحاد الاوروبي لتنظيم اداره ومعالجه واعاده تدوير النفايات الالكترونيه والكېرپايييه بطريقه صديقه للبييه. 5 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] - Zone Regulations: All regulations, guidelines, and directives issued by the Governing Body. - Established Entity: A company or branch operating within the Zone under Article Six of the Zone's regulation. - Waste Management Entity: An entity licensed by the Governing Body to recycle and manage waste, including e-waste, operating within the Zone under a lease with the Zone's Operator. - Waste Management Service Provider: A company contracted by the Operator to provide waste management services within the Zone. - Waste Producer: Any established entity or licensed entity generating waste within the Zone, as classified in the Guideline. - Waste Management: Includes but not limited to, the process of E waste collection, treatment, recycling, and disposal, adhering to environmental and social standards to mitigate health and environmental risks. لوا اتح المنقطه: جميع لوا اتح المنقطه والادله الارشاديه والقرارات والتعليمات والتعليم التابعه لها الصادره من الجهه المختصه. المنشاه القايمه: اي شركه او فرع شركه يمارس داخل المنطقه نشاط او اكثر من انشطه المنقطه. منشاه اداره النفايات: المنشاه المرخص لها من قبل الجبهه الختصه لمارسه انشطه اعاده التدوير واداره النفايات الالكترونيه والذي يؤجر او يؤجر من الباطن او يشغل بطريقه اخري اي جزء من الارض او الوحدات في المنطقه بموجب عقد ايجار مع الجبهه المشغله للمنطقه. مقدم خدمه اداره نفايات في المنطقه: الشركه المتعاقده مع الجهه المشغله لتقدمي خدمات اداره النفايات المنطقه ومرافقها. منتج النفايات: اي منشاه قايمه او كيان مصرح له ينتج نفايات داخل المنطقه حسب التصنيف الوارد في الدليل الارشادي. اداره النفايات: تشمل علي سبيل المثال لا الحصر عمليه جمع ومعالجه واعاده تدوير والتخلص من النفايات الالكتربيه مع مراعاه المعايير البيييه والاجتماعيه للحد من التاثيرات السلبيه علي الصحه والبييه. 6 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] - Waste: Materials or objects discarded, intended for disposal, or required to be disposed of, including electronic and hazardous waste. - E-Waste: Discarded electrical and electronic equipment, including components rejected during manufacturing or repair, as well as obsolete or unwanted electronic devices. Example include: 1. Consumer electronics (e.g., televisions, computers, mobile phones). 2. Industrial electronics (e.g., machine control systems). 3. Rejected materials from the manufacturing or repair of electronic devices. - Hazardous Waste: Any solid, liquid, or gaseous material classified as hazardous by the Governing Body due to its potential health or environmental risks, including toxic, corrosive, flammable, or reactive materials. النفايات: المواد او الاشياء التي يتم التخلص منها او المقصود التخلص منها او المطلوب التخلص منها في ذلك النفايات الالكترونيه والنفايات الخطره. النفايات الالكترونيه: المعدات الكهرباييه والالكترونيه، التي يتم التخلص منها كليا او جزييا كنفايات، بما في ذلك الاجزاء التي يتم رفضها خلال عمليات التصنيع والاصلاح والمعادلات الكهرباييه او الالكترونيه المهمله التي لم تعد صالحه للاستخدام او مرغوبه. ومن الامثله علي ذلك: الاجهزه الالكترونيه الاستهلاكيه (مثل اجهزه التلفاز واجهزه الحاسوب والهواتف المحموله). . الالكترونيات الصناعيه (مثل انظمه التحكم في الالات). . المواه المرفوضه من عمليه التصنيع او الاصلاح للاجهزه الالكترونيه. النفايات الخطره: اي ماده صلبه او سايله او غازيه مصنفه علي انها خطره من قبل الجبه المختصه او الجبه المشغله بسبب مخاطرها المحتمله علي الصحه او البييه، بما في ذلك اي مواد نفايات مصنفه بموجب اتفاقيه بازل علي انها خطره، والتي تحتوي علي مواد سامه، او قابله للاشتعال، او لكتفاعل او مواد مسببه للتاكل مثل البطارات المستهلكه والمدات المحتويه علي الزنبق. 7 GACA الهييه العامه للطيران المدني General Authority of Civil Aviation - Landfill: An external site within the mainland for the disposal of non-recyclable or authorized waste, approved by the National Center for Waste Management. • Center: The National Center for Waste Management, a government body managing waste within the mainland, established under Cabinet Decision No. 457 on 11/8/1440H. • Authority: The Zakat, Tax, and Customs Authority. مردم; موقع او مرفق خارجي داخل البلد الرييس للتخلص من النفايات الغير قابله لاعاده التدوير او النفايات الاخري المسرح بها او المسموح لها بالعمل لهذا الغرض من قبل المركز الوطني لاداره النفايات. المركز: المركز الوطني لاداره النفايات، مركز حكومي يعي باداره النفايات في البلد الرييس انشي بموجب قرار مجلس الوزراء رقم 457 وتاريخ و 8/11 ه. هدف تنظيم ومراقبه انشطه اداره النفايات وتحفيز الاستثمار فيها وتحسين جودتها استنادا الي مبدا الافتصاد الدايري في اداره النفايات لتحقيق اهداف التنميه المستدامه. الهينه: هييه الزكاه والضريبه والجمارك. 8 GACA الهنيه العامه للطيران المدني General Authority of Civil Aviation Chapter One: General Provisions الفصل الاول: الاحكام العامه Article Two: Purpose of the Regulation الماده الثانيه: الغرض من اللاتحه The purpose of this Regulation is to establish a regulatory framework for the management and recycling of E- Waste and Hazardous Waste within the Zone under the supervision of the Governing Body. The Regulation aims to: 1. Promote recycling, reuse and repair of E-Waste to achieve the zone's objectives. 2. Manage E- Waste in a manner that supports the protection of human health and the environment in accordance with best practices, including WEEE Labex standards. 3. Determine the roles and responsibilities of the Governing Body, operators of logistics zones, existing facilities and waste management facilities. 4. Comply with the main provisions of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal. الغرض من هذه اللاتحه وضع اطار تنظيمي لاداره النفايات الالكترونيه والنفايات الخطره واعاده تدويرها داخل المنطقه التي تخصع لاشراف الجبهه المختصه، وتهدف اللاتحه الي ما يلي: 1. تعزيز اعاده تدوير النفايات الالكترونيه واعاده استخدامها واصلاحها لتحقيق مستهدفات المنطقه. اداره النفايات الالكترونيه بما يدعم حمايه صحه الانسان والبييه وffgla الافضل الممارسات والمتضمنه معايير وبي لابكس (WEEE) .(Labex تحديد ادوار ومسؤوليات الجبه المختصه والجهات المضغله للمناطق اللوجستيه والمنشات القايمه ومنشاه اداره النفايات. المعتثال للاحكام الرييسيه الوارده في اتفاقيه بازل بشان التحكم في نقل النفايات الخطره عبر الحدود والتخلص منها. 9 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] Article Three: Scope and Application الماده الثالثه: نطاق التطبيق The Regulation applies to all entities within the Zone, including: 1. Established Entities, Operator, subcontractors, or third parties handling waste. 2. Activities like E-Waste collection, segregation, storage, transportation, recycling, and disposal. Article Four: Requirements for Licensing Electronic Waste Management and Recycling Activities Establishments wishing to practice E- Waste management and recycling activities within the Zone must: 1. Fulfill the requirements set forth in the Investment Regulations. تنطبق هذه الالانحه علي جميع المنشات داخل المنطقه، بما في ذلك: 1. المنشات القايمه ومنشات اداره النفايات والجهات المشغله والمقالولين من الباطن ومقدمي خدمات اداره النفايات او الجهات الخارجيه الذين يتعاملون مع النفايات داخل المنطقه. 2. الانشطه المرتبطه اداره النفايات الالكترونيه واعاده تدويرها مثل جمع النفايات وفصلها وتخزينها ونقلها واعاده تدويرها والOTKLص منها. الماده الرابعه: متطلبات ترخيص نشاط اداره النفايات الالكترونيه واعاده تدويرها يجب علي المنشات التي ترغب بممارسه انشطه اداره النفايات الالكترونيه واعاده تدويرها داخل المنطقه القيام بما يلي: 1. استيفاء المتطلبات الوارده في لايحه الاستثمار. 10 GACA الهييه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] 2. Fulfill the technical operational requirements set forth in the Guideline, and any other requirements or standards determined by the Governing Body. 3. Submitting supporting documents to prove the efficiency of the applicant in line with the requirements set forth within the Guideline. Article Five: Obligations of the Waste Management Facility and Waste Management Service Providers 1. The waste management facility within the zone must comply with the following: A- The regulations and guidelines of the zone. B- Exercise due diligence regarding waste. C- Sort waste into specific categories at the source. D- Send the notifications required by the zone regulations at the specified times. 2. Waste management service providers must comply with the following: A- The regulations and guidelines of the zone when carrying out E- Waste management work. . استيفاء المتطلبات الفنيه التشغيليه الوارده في الدليل الارشادي، 2 واي اشتراطات او معاير اخري تحديدها الجهيه المختصه. 3. تقدميم المستندات الداعمه لاثبات كفاءه المنشاه مقدمه الطلب بما يتماشي مع المنطلبات في الدليل الارشادي. الماده الخامسه: التزامات منشاه اداره النفايات ومقدمي خدمات اداره النفايات يجب علي منشاه اداره النفايات داخل المنطقه الالتزام بما يلي: اللوايح والادله الارشاديه للمنطقه. ب- ممارسه العنايه الواجبه فيما يتعلق بالنفايات. ت- فرز النفايات الي فنات محدده عند المصدر. ث- ارسال الاخطارات المطلوبه بموجب لوايح المنطقه في اوقاتها المحدده. يجب علي مقدمي خدمات اداره النفايات الالتزام بما يلي: لوايح المنطقه والادله الارشاديه التابعه لها عند القيام باعمال اداره النفايات الالكترونيه. 11 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] B- Obtain the necessary licenses from the main country to provide these services. ب- الحصول علي التراخيص اللازمه من البلد الرييس لتقدم هذه الخدمات. Article Six: Obligations of the Operator الماده السادسه: التزامات الجبه المشغله The Operator must adhere to the following: 1. Prepare a Guideline that includes technical details related to E-Waste management and recycling to ensure the achievement of the objectives of the Regulations based on the approval of the Governing Body. 2. Develop E- Waste management plan that complies with the Zone Regulations. 3. Provide a central facility/facility for collecting, separating and storing Waste. 4. Contract with licensed recycling companies and facilities to dispose of E-Waste. يجب علي الجبه المضغله الالتزام بما يلي: 1. اعداد دليل ارشادي يتضمن التفاصيل الفنيه الخاصه باداره النفايات الالكترونيه واعاده تدويرها بما يضمن تحقيق اهداف هذه ل'التحه بناء علي موافقه الجبهه المختصه. 2. وضع خطه لاداره النفايات الالكترونيه تتوافق مع لوايح المنطقه الخاصه اللوجستيه المتكامله. 3. توفير مرفق/مرافق مركزيه لجمع وفصل وتخزين النفايات. 4. التعاقد مع شركات ومرافق اعاده التدوير المرخصه للتخلص من النفايات الالكترونيه. 12 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] Chapter Two: Waste Management Operations الفصل الثاني: عمليات اداره النفايات Article Seven: Collection and Separation الماده السابعه: الجمع والالفصل 1. All entities must separate Waste, including E-Waste, and ensure that their functional components such as batteries, screens, and circuit boards are identified. 2. Inspection must be in accordance with the Basel Convention standards that define the classification of Waste based on hazard levels, and as stipulated in the Guidelines. 3. Hazardous Waste must be stored separately from other Waste to avoid cross-contamination. 4. Hazardous Waste must be clearly marked to avoid leakage and contamination, in accordance with the handling and storage standards contained in the Guidelines and International Safety Standards. يجب علي المنشات فصل النفايات بما في ذلك النفايات الالكترونيه، والتاكد من تحديد مكوناتها الوظيفيه مثل البطارات والشاشات ولوحات الدواير. يجب ان يكون الفحص وفقا لمعاير اتفاقيه بازل التي تحدد تصنيف النفايات بناء علي مستويات الخطر، ووفقا لما هو منصوص عليه في الدليل الارشادي لاداره النفايات الالكترونيه. يجب ان يتم تخزين النفايات الخطره بشكل منفصل عن النفايات الاخري لتجنب التلوث المتبادل. يجب ان يتم وضع علامات واضحه علي النفايات الخطره لتجنب التسرب والتلوث وذلك بما يتوافق مع معابير المناوله والتخزين الوارده في الدليل الارشادي ومعابير السلامه الدوليه. 13 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] Article Eight: Transfer of Ownership الماده الشامنه: نقل الملكيه 1. The Waste producer shall be the owner of all Waste they generate until the ownership is transferred to the Waste Management Service Provider or Waste Management Entity for disposal or until it is transported and until it reaches the mainland. 2. The Waste producer or Waste Management Entity shall assume responsibility for the Waste it generates until ownership is officially transferred to another approved party or the Center in the Mainland, upon the issuance of the waste transfer document. 3. The Waste shall be transferred to the ownership of the Center in the Mainland when the Waste is disposed of in the places, landfills or containers designated by the Center in the Mainland for this purpose or for collecting and storing Waste in public places, and the Waste disposed of in areas near these locations or containers shall also be considered the property of the state. 1. يعد منتج النفايه مالك لكل النفايات التي ينتجبها حتي يتم نقل ملكيتها الي منشاه اداره النفايات او مقدم خدمات اداره النفايات للتخلص منها او الي ان يتم نقلها و حتي وصلها الي البلد الرييس. 2. يلترم منتج النفايه او مقدم خدمات اداره النفايات بتحمل المسؤوليه عن النفايات التي ينتجها حتي يتم نقل ملكيتها الي جهه اخري معتمده او نقل ملكيتها الي المركز في البلد الرييسي، بصدور وثيقه النقل الخاصه بهذه النفايات. 3. تنتقل النفايات الي ملكيه المركز في الالييس عند التخلص من النفايات في الاماكن او الماردام او الحاويات التي يخصصها المركز في البلد الرييس لهذا الشان او لجمع وتخزين النفايات في الاماكن العامه، وتعد النفايات التي يتم التخلص منها في المناطق القربيه من تلك الاماكن او الحاويات ملك للدوله ابيضا. Facilities must include separate container systems for hazardous materials, and storage areas must be equipped with ventilation and fire suppression systems in line with the Guideline requirements. 2. During transportation, E-Waste and hazardous waste must be transported in closed and labeled containers, and they must be transported by a Waste Management Entity or Waste Management Service Provider to ensure environmental and public safety in line with the requirements contained in the Guideline. 3. Documents attached to the transported Waste must include information about the source of the waste, the destination, and the type of waste. يجب ان تتضمن المرافق انظمه حاويات منفصله للمواد الخطره ويجب ان تكون مناطق التخزين معجره بانظمه تهويه واطفاء الحرايق بما يتماشي مع الاشتراطات الوارده في الدليل الارشادي. 2. عند القيام بعمليات النقل يجب الالتزام بنقل النفايات الالكترونيه والنفايات الخطره في حاويات مغلفه وموضحه بالملصقات، ويتم نقلها بواسطه منشاه اداره النفايات او مقدم خدمه نقل مرخص لضمان السلامه البيييه والعامه بما يتماشي مع الاشتراطات الوارده في الدول الارشادي. يجب ان تتضمن الوثايق المرفقه بالنفايات المنقوله معلومات عن مصدر النفايات والوجهه ونوع النفايات. 15 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] Article 10: Recycling and Disposal of E-Waste 1. The Waste Management Entity's and Established Entity's, when carrying out E-Waste recycling operations, must comply with the international standards for recycling E-Waste and the requirements contained in the Guidelines. 2. Established Entities, in the event that they do not carry out E-Waste recycling operations within the region, must commit to delivering E-Waste to approved recycling facilities in the main country and disposing of its hazardous materials in accordance with the procedures mentioned in the Guidelines. Article Eleven: Sustainability 1. The Operator is committed to promoting sustainable waste management practices, through the following: A. Encouraging entities to adopt circular economy principles by repairing, renewing, reusing and recycling electronic equipment. B. Utilizing technologies and solutions aimed at saving energy during waste management operations, including but not limited to the use of renewable energy. الماده العاشره: اعاده التدوير والOTخلس من النفايات الالكترونيه يجب علي منشاه اداره النفايات والمنشاه القايمه عند القيام بعمليات اعاده تدوير النفايات الالكترونيه الالتزام بالمعايير الدوليه لاعاده تدوير النفايات الالكترونيه والمتطلبات الوارده في الدليل الارشادي. يجب علي المنشاه القايمه في حال عدم القيام بعمليات اعاده تدوير النفايات الالكترونيه داخل المنطقه، الالتزام بتسليم النفايات الالكترونيه الي ارماق اعاده التدوير المعتمده في البلد الرييس والاتخلص من موادها الخطره بما يتوافق مع الاجراءات المذكوره في الدوليل الارشادي. الماده الحاديه عشره: الاستدامه تلازم الجبه المضغله بالعمل علي تعزيز ممارسات اداره النفايات المستدامه، من خلال ما يلي: تشجيع المنشات علي تبني مبادي uneاقتصاد الدايري من خلال اصلاح وتجديد واعاده استخدام وتدوير المعدات الالكترونيه. ب. استخدام وتقنيات وحلول تهدف الي توفير الطاقه خلال القيام باعمال اداره النفايات علي سبيل المثال لا الحصر استخدام الطاقه المتجده. 16 GACA الهييه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] C. Working to design programs to achieve zero carbon emissions targets within the Zone. D. Encouraging entities to reduce waste generation by developing operational efficiency and participating in training programs provided by the operating entity on sustainable waste management. Article Twelve: Emergency Response Plans 1. Waste Management Entity must develop an emergency response plan (ERP), which includes procedures for dealing with incidents involving the leakage of hazardous materials resulting from waste or the leakage of E- Waste. 2. ERP must include mechanisms for using specialized teams to deal with emergencies, precautionary measures to absorb the leakage of hazardous materials resulting from waste, and a mechanism for reducing the damage resulting from these incidents. 3. The Operator is committed to conducting regular training courses for Established Entities to ensure readiness and preparedness to deal with any emergency incident. ت. العمل علي تصميم برامج لتحقيق مستهدفات الانبعاثات الكربونيه الصفريه داخل المنطقه. ث. تشجيع المنشات علي تقليل توليد النفايات من خلال تطوير الكفاءه التشغيليه، والمشاركه في برامج التدريب التي تقدمها الجهه المشغله حول اداره النفايات المستدامه. الماده الثانيه عشره: خطط الاستجابه للطواري 1. يجب علي منشيات اداره النفايات وضع خطه استجابه للمطواري (ERP), تشمل الاجراءات الخاصه بالتعامل مع الحوادث التي تتضمن علي تسرب المواد الخطره النجامه عن النفايات او تسرب من النفايات الالكترونيه. يجب ان تتضمن خطط الاستجابه للطواري اليات الاستعانه بالفرق المختصه للتعامل مع حالات الطواري، والتدابير الاحترازيه لاستيعاب المواد الخطره المدرسه الناجمه عن النفايات واليه الحد من الاضرار الناجمه عن هذه الحوادث. 3. تلازم الجبه المضغله باجراء دورات تدريبيه منتظمه للمنشيات القايمه لضمان الجاهبيه والاستعداد لمواجهه اي حادث طاري. 17 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] Article Thirteen: Stock Amendments and Customs Procedures 1. The Governing Body shall coordinate with the Authority to prepare a mechanism for customs procedures for E-Waste management. 2. Established Entities shall be allowed to deduct recycled waste quantities from their stock upon obtaining the Authority's approval. 3. Established Entities shall be allowed to transfer ownership of waste and electronic waste to other Established Entities and Waste Management Entity within the Zone. 4. Waste and E-Waste shall be allowed to be removed from the Zone and customs procedures shall be applied according to the type of customs declaration and the final destination. الماده الثالثه عشره: تعديلات المخزون والاجراءات الجمركيه 1. تقوم الجهه المختصه بالتنسيق مع الهينه اعداد اليه الاجراءات الجمركيه الخاصه اداره النفايات الالكترونيه. 2. يسمح للمنشات القايمه خصم كميات النفايات المعاد تدويرها من مخزونهم عند الحصول علي موافقه الهينه. 3. يسمح للمنشات القايمه بنقل ملكيه النفايات والمخلفات الالكترونيه الي منشات قايمه داخل المنطقه. 4. يسمح باخراج النفايات والمخلفات الالكترونيه من المنطقه وتطبق الاجراءات الجمركيه بحسب نوع البيان الجمركي والوجهه النهايه. 18 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] Article Fourteen: Import and Export Procedures 1. The Established Entities and Waste Management Entity shall abide by the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal in the event that they dispose of hazardous waste by exporting it to another country. 2. It is prohibited to import or bring hazardous waste from the Mainland or another country into the Zone except after obtaining the approval of the Governing Body, which requires - as a minimum - the following: A. Determining the type of waste that will be imported by the Waste Management Entity and determining the purpose of its import. B. Determining the quantities required to be imported. C. Obtaining the required approvals to import waste in accordance with the Basel Convention according to the type of waste. D. Submitting a report proving that it is free of radioactive contamination. الماده الرابعه عشره: اجراءات الاستيراد والتصدير تلتزم المنشاه القايمه ومنشاه اداره النفايات باتفاقيه بازل بشان التحكم في نقل النفايات الخطره والتخلص منها عبر الحدود في حال قيامها بالتخلص من النفايات الخطره عن طريق تصديرها الي دوله اخري. 2. يحظر استيراد او ادخال النفايات الخطره من البلد الرييس او دوله اخري الي المنطقه الا بعد صدور موافقه الجبهه المختصه والتي يشترط للحصول عليها - كحد ادني - ما يلي: ا. تحديد نوعيه النفايات التي سيتم استيرادها من قبل منشاه اداره النفايات وتحديد الغرض من استيرادها. ب. تحديد الكميات المطلوب استيرادها. ت. الحصول علي الموافقات المطلوبه لاستيراد النفايات وفقا لاتفاقيه بازل يحسب نوع النفايات. ش. تقدمي تقرير يثبت خلوها من التلوث الاشعاعي. 19 GACA الهييه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] E. The imported materials shall be used in the industrial process at a rate of 100% and shall not produce waste that is transferred to landfills. F. Contracting with a licensed collection and transportation service provider. 3. E-Waste may be exported outside the Zone to another country for the purpose of treatment, additional treatment or final disposal - in the event that waste management facilities are not available to deal with such waste within the Zone or the Mainland- after obtaining approval from the Governing Body, and when the following conditions are met: A. The local market does not need the type of waste to be exported. B. Providing the Governing Body with a report on the type of waste to be exported by the facility. C. Meeting the requirements necessary for exporting waste according to the Basel Convention according to the type of waste. D. Submitting a laboratory test report for the waste from an accredited laboratory (within the three months preceding the submission of the approval application, maximum). % 100 ان تستخدم المواد المستوده في العمليه الصناعيه بنسبه ٥٠. ولا ينتج منها نفايات يتم تحويلها الي المرادم. التعاقد مع مقدم خدمه جمع ونقل مرخص له. 3. يسمح بتصدير النفايات الالكترونيه خارج المنطقه الي دوله اخري بغرض المعالجه او المعالجه الاضافيه او التخلص النهايي - في حال عدم توافر مرافق اداره النفايات للتعامل مع هذه النفايات داخل المنطقه او البلد الرييس – بعد الحصول علي الموافقه من الجبهه المختصه، وعند توافر الشروط الاتيه: ا. عدم احتياج السوق المحلي لنوع النفايات المطلوب تصديرها. ب. تزويد الجبهه المختصه بتقرير عن نوعيه النفايات التي سيتم تصديرها من قبل المنشاه. ت. استيفاء الاشتراطات اللازمه لتصدير النفايات وفقا لاتفاقيه بازل بحسب نوع النفايات. ث. تقدمي تقرير الاختبار المخبري للنفايات من مختبر معتمد (خلال (الشر الثالثه السابقه لتقدمي طلب الموافقه كحد اقصي). 20 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] C. Contracting with a service provider licensed to collect and transport waste. 4. Anyone wishing to transport hazardous waste to the Mainland must obtain a waste transit approval from the Governing Body, and the following conditions must be met to obtain it - at a minimum -: A. Determining the type of waste to be transited. B. Determining the quantities required to be transited. C. Obtaining the required approvals for waste transit in accordance with the Basel Convention. 5. Governing Body may exempt the applicant from some of these conditions, and it may add any other conditions. . التعاقد مع مقدم خدمه مرخص له بجمع ونقل النفايات. يجب علي من يرغب بنقل النفايات الخطره الي البلد الرييس الحصول علي موافقه عبور نفايات من الجبهه المختصه، ويشترط للحصول عليها - كحد ادني - ما يلي: تحديد نوعيه النفايات التي سيتم عبورها. ب. تحديد الكميات المطلوب عبورها. ت. الحصول علي الموافقات المطلوبه لعبور النفايات وفقا لا تفاقيه بازل. 5. يمكن للجهه المختصه استثناء مقدم المطب من بعض هذه الشروط، كما يمكن لها اضافه اي اشتراطات اخري. 21 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation Chapter Three: Final Provisions الفصل الثالث: احكام ختاميه Article Fifteen: Monitoring and Inspection الماده الخامسه عشره: المراقبه والتفشيش 1. The Governing Body shall undertake monitoring, auditing and review operations to verify the compliance of Waste Management Entity and Established Entities with the provisions of these Regulations. 2. The Governing Body may seek assistance from relevant authorities to carry out monitoring and inspection tasks on Waste Management Entity and Established Entities in the Zone. 3. The Waste Management Entity and waste producer must enable the inspector carrying out inspections to perform their duties immediately upon presenting supporting documents or a letter stating that he has been appointed by the Governing Body as an inspector. 4. The Waste Management Entity and waste producer must not prevent or hinder inspectors from carrying out inspection work, and if they are prevented or hindered from carrying out their work, the inspector shall document this in a report; to take the necessary measures. 1. تتولي الجبهه المختصه عمليات المراقبه والتدقيق والمراجعه لتحقق من التزام منشاه اداره النفايات والمنشيات القايمه باحكام هذه اللايحه. 2. يجوز للجهه المختصه الاستعانه بالجهات ذات العلاقه للقيام بمهام المراقبه والTNFITUS علي المنشيات القايمه في المنطقه. 3. يجب علي منشاه اداره النفايات ومتج النفايات تمكن من يقوم باعمال التفييش من اداء مهامه فور ابراز اوراق ثبوتيه او خطاب يفيد تسميته من الجبه المختصه مفتشا. 4. يجب علي منشاه اداره النفايات ومتج النفايات عدم منع او اعاقه المفتشين من القيام باعمال التفييش، واذا تم منعمهم او اعاقتهم من قيام اعمالهم فيقوم المفتش بتوثيق ذلك في محضر: لاتخاذ الاجراءات اللازمه. 22 GACA الهينه العامه للطيران المدني General Authority of Civil Aviation [Non-Text] Article Sixteen: Review and Amendment 1. The Governing Body has the right to review this Regulation every two years to ensure compliance with updated international standards and developments in electronic waste management and recycling technologies. 2. Proposed amendments will be subject to the necessary consultations and will be published if amended. Article Seventeen: Effectiveness and Application These Regulations shall enter into force from the date of publication. يحق للجهه المختصه مراجعه هذه الاليحه كل سنتين لضمان التوافق مع المعاير الدوليه المحنه والتطورات في تقنيات اداره النفايات الالكترونيه واعاده تدويرها. 2. ستخضع التعديلات المقترحه للاستثارات اللازمه وتنشر في . حال تعديلها. الماده السابعه عشره: السريان والتطبيق تدخل هذه اللايحه حيز التنفيذ من تاريخ النشر. 23
