الهييه العامه للسياحه واللوات الوطني Saudi Commission for Tourism & National Heritage (7) رييس الهييه قرار مجلس الاداره رقم (٢٨/١٥ و تاريخ ١٣٤) ان مجلس اداره الهييه العامه للسياحه والتراث الوطني، وبناء علي الصلاحيات المخوله له نظاما، وبناء علي الماده الثالثه والتسعين من نظام الاثار والمتاحف والتراث العمراني الصادر بالمرسوم الملكي رقم (م/٣) وتاريخ ١٤١٦٦١٩ وبعد الاطلاع علي محضر مجلس اداره الهينه لجستنه الثامنه والثلاثين التي عقدت بتاريخ ٥١٤٣/٨/١٠ يقرر ما يلي: اولا: اصدار لايحه التفتيش وضبط مخالفات نظام الاثار وال متاحف والتراث العمراني، بالصيغه المرفقه لهذا القرار. ثانيا: ينشر هذا القرار واللايحه المرفقه به بالجريده الرسميه، ويعمل به اعتبارا من تاريخ النشر العر رييس مجلس الاداره سلطان بن سلمان بن عبد العزيز ص ب ٧٦٦٦،الرباح ١١٥٨٦،المملكه العربيه السعوديه، هاتف ٩٦٦٦ ١١٨٨٠،٨٩٠ فاكس ٩٦٦ التاليه - انما وردت في هذه للاتحه - المعاني الموضحه امام كل منها، ما لم يقتض السياق معني اخري: الهييه العامه للسياحه والتراث الوطني. الرييس : رييس النظام : نظام الاثار والمتحف والتراث العمراني. اللجنه الفرز الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الثاني التقني والضبط الماده الثانيه: - يتولي موظفو الهييه - الذين يصدر بتسميتهم قرار من الرييس - مراقبه المواقع، والMBاني الاثرييه، والتراثيه، والمناتاح، والاشطه التي تتم ممارستها؛ وفقا لاحكامالنظام، ولوايحه، وضبط ما يقع من مخالفات لاحكامالنظام. - للهينه، بالاتفاق مع الجهات الاخري، الاستعانه بموظفي تلك الجهات المخولين من جهاتهم: لممارسه المهيات المنصوص عليها في الفقره (1) من هذه الماده. - بعد الموظفون المشار اليهم في الفقرتين (1) ومن هذه الماده - اثناء قيامهم باعمالهم، وفي حدود اختصاصهم. من رجال الضبط الجنايي. - تمنح الهييه موظف الضبط بطاقه تحمل صورته، ومختومه بالختم الرسمي للهييه، وذلك لاثبات صفته الرسميه عند قيامه بمهمات التفتيش، والضبط، وعليه اعاده هذه البطاقه عند تركيه لعمله في التفتيش والضبط. الماده الثالثه: يباشر موظف الضبط مهمات عمله خلال ساعات الدوام الرسمي، او خارجها، وذلك وفق جداول مسبقه تعتمدها الاداره المختصه التي يتبع لها الموظف، ويراعي في الجداول عدد، وحجم المواقع والemanي الخاضعه للفتييش ضمن نطاق اختصاص الاداره المختصه. ويمكن - في الحالات الاستثناييه، ويحسب مقتضيات العمل - اجراء التفتيش دون التقيد بالجداول. الماده الرابعه: مع مراعاه الانظمه ذات العلاقه، لموظف الضبط - في سبيل مباشرته لمهاته - القيام بما يلي: السماعيليه والثانويه السماعيليه والثانويه السماعيليه والثانويه السماعيليه والثانويه السماعيله والثانويه السماعيله والثانويه السماعيله والثانويه من الاشطه الخاصه لاحكام النظام، ولوايحه، وذلك بعد ابراز بطاقته التعرفيه للمسؤول عن الموقع، او المبني. او من يمثله. في وقت الزياره، في حال عدم وجود اي منهم، فيعرف الموظف بنفسه للشخص الموجود في الموقع، او المبني وقت الزياره. - ٢-الاطلاع علي المستندات، والسجلات، والتراخيص، والموافقات، واي وثيقه اخري ذات صله. معاينه الموقع، او المبني ومراقفه، وسؤال المسول عن الموقع، او المبني - او من يمثله - واي من العاملين ; للتحقق من توافر الاشتراطات، والمتطلبات اللازمه؛ وفقا لما يقضي به النظام، ولوايحه، وتدوير ذلک - اذا استدعي الامر - في محضر الضبط. - سماع اقوال الشاكين، والتحقق منها، ومواجهه المشكوز ضدهم بالشكاوي. الماده الخامسه: - دون اخلال بما ت-Qضي به الانظمه ذات العلاقه، علي ملاك المواقع، والMBاني الاثريه والتراثيه، والمرخص لم، والخاصлин علي موافقات من الهينه، والمدير المسول عن الموقع، او المبني - او من يمثله - والعاملين فيه، تمكين موظفي الضبط من الدخول، ومباشره مهماته، وتزويدهم بما يطلبونه من سجلات، ومدتات؛ وذلك لاحظاع عليها، والتحقق من الالتزام باحكام النظام ولوانجه. - اذا اعاق اي من الاشخاص المشار اليهم في الفقره (1) من هذه الماده عمل موظف الضبط، فعلي الموظف تدوين ذلك في محضر الضبط. الماده السادسه: علي موظف الضبط توحي الحرص، والامانه، والدقه في القيام بمهماته، وعليه بوجه خاص ان يوسس ملحوظاته علي ما يشاهده بنفسه، وان يمتنع كليا عن ايداء اي ملحوظه عن الامور التي لا يلم بها المما كافيا. الشرك 1/4 الهييه العامه للسياحه والتراثات الواي Saudi Commission for Tourism & National Heritage الماده السابعه: - يحرر موظف الضبط. علي النموذج المعتمد من الهييه، محضرا بال مخالفات التي يتم ضبطها، يبين فيه نوع المخالفه، وتاريخ ضبطها، وافاده المدير المسؤول عن الموقع، او المبني، او من يمثله. - يوقع موظف الضبط علي المحضر، يطلب من المدير المسؤول عن الموقع او المبني، او من يمثله - التوقيع عليه، وفقي حاله رفض اي منهم التوقيع، فيتم اثبات ذلك في المحضر - وتسليم المدير المسؤول عن الموقع، او المبني - او من يمثله. - نسخه منه. - اذا اتضح لموظف الضبط اثناء التفتيش وجود مخالفات، او جرايم معاقب عليها بموجب انظمه اخري، فعليه ابلاغ الاداره المختصه بذلك، وعلي الاداره المختصه اتخاذ ما يلزم لاحالتها الي الجهات المعنيه. - ٤- يرفع موظف الضبط محضر الضبط الي الاداره المختصه، تمهيدا لاستكمال الاجراءات اللازمه في شان المخالفه، ومن ثم احالتها الي اللجنه المنصوص عليها في الفقره (1) من الماده (الثامنه) من هذه اللاتحه، او احالتها الي هييه التحقيق والاداءات العام اذا كانت من المخالفات المنصوص عليها في الموال (الحاديه والسبعين، والثانيه والسبعين، والثالثه والسبعين) من النظام. الاستعماله والتاثيه الاستعماله احمدم - علي الاقل - مستشار شرعيا، او نظاميا؛ للنظر في المخالفات، وطبيق الغرامات المنصوص عليها في المواد (الرابعه والسبعين، والخامسه والسبعين، والسندسه والسبعين، والسابعه والسبعين) من نظام. ويحدد القرار رييس اللجنه والعضو الاحتياطي الذي يحل محل احد الاعضاء حال غيابه. ٢ - مده العضويه في اللجنه (ثلاث) سنوات قابله للتجديد لمده، او ممد مماليه. الماده التاسعه: تعقد اللجنه جاستها في مقر الهييه بضرور ثلايه اعضاء، علي ان يكون من بينهم المستشار الشرعي، او النظامي. ويجوز للجنه ان تعقد جاستها في مكان اخري بموافقه الرييس. الماده العاشره: اذا تعذر علي احد اعضاء اللجنه الاستمرار في عضوياتها، او تغيب عن الحضور (ثلاث) جلسات متتاليه، او (خمس) جلسات متفرقه خلال السنه الواحده دون عذر قلبه الهييه، فيعرض رييس اللجنه الامر علي الرييس للنظر في اصدار قرار بانها عضويته، وتعيين من يحل محله للمده المتبقيه من عضويته. واذا كان العضو المتغيب هو رييس اللجنه، فتعرض الاداره المختصه الامر علي الرييس للنظر في اصدار قرار بانها عضويته، وتعيين من يحل محله للمده المتبقيه منها. الموزي للسياحه والتنميه Use President's Office 14/4 الفرح الوثيقه العامه للسياحه والتراث الحلي Saudi Commission for Tourism & National Heritage الماده الحاديه عشره: يعد لكل جلسه من جلسات اللجنه محضر ثنين فيه اسماء اعضايها الحاضرين، وتاريخ ووقت افتتاح الجلسه، ومكان انعقادها، وجميع الاجراءات والوقايع التي تتم خلالها. ويوقع المحضر من الاعضاء الحاضرين وامين السر، وكذلك المخالف اذا كان حاضرا للجسه. الماده الثانيه عشره: للجنه دعوه من تراه من الفصل الرابع اليه عمل اللجنه الماده الثالثه عشره: - 1 - تحال المخالفات - بعد استكمال اجراءات الضبط - الي اللجنه بناء علي توجيه من الرييس. - 2 - لرييس اللجنه مخاطبه اي من قطاعات الهينه، او اداراتها لطلب ما تحتاجه اللجنه من وثايق، او بيانات، او معلومات، او دراسات تتعلق بالمخالفه محل النظر. وللجنه - من خلال الرييس - مخاطبه اي جهه (حكوميه او خاصه) في هذا الشان. - 3 - للجنه ان تقوم بما تراه ضروريا لاستكمال التحقيق في المخالفه المعروضه عليها، ولها اجراء المعاينه بهييتها الكامله، او ندب احد اعضايها لهذه المهمه، علي ان يقدم للجنه - خلال المده التي تحددها - تقريرا بنتيجه المعاينه. - 4 - للجنه اذا اتضح لها وجود ملحوظات علي اليه ضبط المخالفه : اعاده الموضوع الي القطاع المختص، مشفوعا بملحوظاتها. الماده الرابعه عشره: - 1 - للجنه - اذا اقتضي الامر - استداع المخالف (او من يمثله نظاما) لسماع اقواله حول المخالفه. ويكون الاستداعه بموجب خطاب رسمي يزود به المخالف قبل التاريخ المحدد لنظر المخالفه ب(خمسه عشر) يوما علي الاقل. - علي المخالف (او من يمثله نظاما) الحضور في الموعد المحدد، فان غاب من غير عذر تفتنع به اللجنه : جاز لها استكمال النظر في المخالفه اذا كانت صالحه للنظر فيها. - في حال عدم حضور المخالف للمره الثانيه علي التوالي تصدر اللجنه قراراتها; وفق ما تراه مناسبا من واقع المستندات التي لديها. الفرق 14/8 الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده الخامسه عشره: لا يجوز لاي من اعضاء اللجنه المشاركه في نظر اي مخالفه اذا كانت له اي علاقه، او خلاف، او مصلحه مع المخالف، او كان قريبا له حتي الدرجه الرابعه. وعلي العضو الاقصاح لرييس اللجنه عن ذلك قبل بدء نظر المخالفه. الماده السادسه عشره: لجنه، اذا رات ان المخالفه تنطوي علي جريمه، او مخالفه معاقب عليها بموجب انظمه اخري، او بموجب احكام النظام لكنها تخرج عن اختصاص اللجنه، ان تحيلها - عن طريق الرييس - الي الجهه المختصه. وعلي اللجنه ان تصل في المخالفه المعروضه عليها، ما لم يتبين لها انه لا يمكن الفصل فيها دون الفصل في المخالفه، او الجريمه التي تخرج عن اختصاصها. الماده السابعه عشره: علي اللجنه عند تقدير العقوبه ان تاخذ في الاعتبار التناسب بينها، وبين المخالفه، وان تراعي في ذلك الظروف الداعيه لتشديد العقوبه. وتعد من الظروف المشدده: - 1- تكرار المخالفه. - 2- تعدد المخالفات. - اذا ترتب علي المخالفه اضرار بالصحه العامه، او الامن العام، او السكنيه العامه، او الممتلكات، او تهديد لاي منها. - اذا اقترنت المخالفه بمحاوله عرقه عمليات التفتيش، او عدم التعاون مع موظفي الضبط. - اذا كان ارتكاب المخالفه عمدا، وليس نتيجه اهمال. الموزيه الماليه واللواحيه Saudi Commission for Tourism & National Heritage 14/9 المركز الهييه العامه للسياحه واللوات الوحني Saudi Commission for Tourism & National Heritage الماده الثامنه عشره: تتخذ اللجنه قراراتها باغلبيه اصوات اعضايها الحاضرين، وعند تساوي الاصوات؛ يكون صوت رييس اللجنه مرجعا، وعلي ميتبني من اعضاء اللجنه رايا مخالفا ان يضمن رايه الخاص، واسبابه في محضر الجلسه. الماده التاسعه عشره: -1 تكون المداوله بين اعضاء اللجنه سريه. -2 يجب ان يشتمل القرار علي اسم المخالف، ووصف المخالفه، وملخص وقايع النظر فيها، ومنطوقه. -3 يجب ان يكون القرار مسبا ومتضمنا الرد علي جميع الدفوع التي تقدم بها المخالف ان وحدت. - ٤- يوقع القرار من رييس اللجنه واعضايها الحاضسين وامين السر. -٥ يعتمد قرار اللجنه من الرييس، ويجوز لمن صدر ضده القرار الاعتراض عليه امام المحكمه الاداريه خلال ستين يوما من تاريخ العلم به. الماده العشرون: تتولي الهييه - بالتنسيق مع الجهات
