The decision of the ICT sector after legal review Ministry of Human Resources and Social Minister’s Office Issue: 53404 Date: 22/03/1442 AH Attachments: NA Ministerial Decision Vision 2030 Kingdom of Saudi Arabia Development Minister’s Office The Minister of Human Resources and Social Development, As per his Statutory Authorities, Having considered the provisions of Article (11) bis. and Article (26) of the Labor Law, issued under Royal Decree No. (M/51) dated 23/08/1426 AH, as amended by Royal Decree No. (M/24) dated 12/05/1434 AH, as amended by Royal Decree No. (M/1) dated 22/01/1435 AH, as amended by Royal Decree No. (M/46) dated 05/06/1436 AH, as amended by Royal Decree No. (M/14) dated 22/02/1440 AH, as amended by Royal Decree No. (M/134) dated 27/11/1440 AH, and as amended by Royal Decree No. (M/5) dated 07/01/1442 AH; Having considered Royal Cable No. (38100) dated 15/08/1433 AH, including the approval of the Nitaqat Program; Ministerial Decision No. (4040) dated 12/10/1432 AH; and Ministerial Decision No. (939) dated 20/06/1438 AH; and given the public interests in regulating the labor market and stimulating businesses to localize jobs; Hereby decides the following: First: Terminate the primary activities of the Incentive Program for Saudization of Jobs in Businesses (Nitaqat), as of 01/08/1442 AH, as follows: Current Activity Information Technology Communication Second: Establish seven (7) primary activities in the Nitaqat Program as per the following list, at the Saudization rates included in attachment of this decision: IT Operation and Maintenance Communications Operation and Maintenance IT Infrastructure Communications Infrastructure IT Solutions Communications Solutions Mail Activities Third: The Ministry shall take all the necessary measures to ensure the compliance of the businesses with this decision. A business that violates this decision shall be subject to penalties set forth in the list of penalties issued under Ministerial Decision No. (178743) dated 27/09/1440 AH, and amendments thereof. Fourth: The attachment regarding the Saudization rates of the new primary activities shall be an integral part of this decision, and both documents shall go into force on 01/08/1442 AH.
