الهييه العامه للسياحه واللوات الوثني Saudi Commission for Tourism & National Heritage (145) رييس الهييه قرار مجلس الاداره رقم (٣٨/٩ وتاريخ ١٥٣٦٨) ان مجلس اداره الهييه العامه للسياحه والتراث الوطني، وبناء علي الصلاحيات المخوله له نظاما، وبناء علي الماده الثالثه والتسعين من نظام الاثار والمناتحف والتراث العمراني الصادر بالمرسوم الملكي رقم (م/٣) وتاريخ ١٤٦٣/٩ وبعد الالطاع علي محضر مجلس اداره الهييه لجسته الثامنه والثلاثين التي عقدت بتاريخ ١٤٣٦/٨/١٥ يقرر ما يلي: اولا: اصدار لاتحه المسح الاثري والتنقيب عن الاثار، بالصيغه المرفقه لهذا القرار. ثانيا: ينشر هذا القرار واللاتحه المرفقه به بالجريده الماده الاولي: تكون للكلمات والعبارات التاليه. اينما وردت في هذه للاتحه. المعاني الموضحه امام كل منها، ما لم يقتض السباق معني اخري: الهينه العامه للسياحه والتراث الوطني. رييس الهينه. نايب الرييس للاثار والمناتح. قطاع الاثار والمتاحف بالهينه. نظام الاثار والمتاحف والتراث العمراني. الانار / مواقع الاثار الاعوان الثابنه، والمنقوله، والمطوره، والغارقه داخل حدود المملكه،})(في المناطق البحريه الخاضعه لسيادتها، او ولايتها القانونيه، التي بناها الانسان، او صنعها، او انتجها، او كيفها، او رسمها، وتكونت لها خصايص اثريه بفعل تدخل الانسان عبر العصور، ان امتد تاريخها الي فتره متاخره، علي اتل عن مايه سنه. واللهينه ان تعد ما يرجع الي عهد احدث اثارا. وتدخل تحت اسم الاثار المواقع التاريخيه ومواقع التراث الشعبي وقطعه. الاثار المتصله بالارض، مثل: الكهوف الطبيعيه، او المحفوره التي استخدمها الانسان، والصخور التي رسم، او حفر عليها صورا، او نقوشا كتابيه، والرجوم، والدواير الحجريه، واطلال المدن، والقري، والمنشات الظاهره، او المطموره تحت الارض، والمنشات الماييه، وطرق التجاره، والحج القديمه، والمدن والقري، والاحياء التقليديه، والابنيه المنشاه لغايات مختلفه، واطلال تلك المباني، وما يتصل بها من عناصر معماريه. القطع الاثريه التي صنعت في الاصل؛ لتكون بطبيعتها منفصله عن الارض، او عن الاثار الثانيه، والتي يمكن تغيير مكانها، كالمنحوات، والمسكوات، والكتابات، واللحلي، وادوات الزينه، والقطع التراثيه، النقبه والثرييه تشكل قيمه وطنيه من حيث طابعها التاريخي، او العلمي، او الحقالي، او الاثار الثانيه الاثار المنقوله التحلاقيه والمراعييه Vice President & Nationality Sancti commission for Tourism & ٢٥/٢ الهييه العامه للسياحه والتراث الوثاني Saudi Commission for Tourism & National Heritage الفني، او التقليدي، او قدم الاستخدام. وثيقه تصدرها الهييه، تخول المرض له مزاوله اعمال المسح الاثري، او التنقيب عن الاثار، او كليها. كل شخص طبيعي، او اعتباري حاصل علي ترخيص ساري المفعول من الهييه لممارسه نشاط المسح الاثري، او التنقيب عن الاثار - او كليها - وفقا لاحكام النظام وهذه اللاتحه. كل شخص طبيعي، او اعتباري يزاول اعمال المسح الاثري، او التنقيب عن الاثار في المملكه. المنطقه الموضحه معالمها، وحدودها، واوصافها في الترخيص الممنوح للمرخص له. جميع اعمال استكشاف مواقع الاثار، وتوثيها بالوسايل العلميه المختلفه، سواء علي سطح الارض، او في باطنها، او تحت الماء. جميع اعمال الحفر، والسبر، والتحري، والغوص التي تتم وفق اسس علميه، وتستهدف العثور علي اثار في باطن الارض، او علي سطها، او في مجاري المساء، او البحيرات، او في المناطق البحريعه الخاصه لسياده المملكه، او ولايتها القانونيه. كل شخص طبيعي، او اعتباري مؤهل علميا ومهنيا في مجال التتقيب عن الاثار. تحديد درجه اهميه الاثر، وذلك وفقا لقيمته التاريخيه، او الثقافيه، او الفنيه، او العلميه، او الوظنيه. الدراسه العلميه والبحثيه التي يقوم بها باحث لموقع، او لماده اثريه في متحف او في مستوي دعات القطاع، دون ان تتطلب الدراسه مسحا اثريا او تتقيا عن الاثار. المكان الذي تعرض فيه مواد اثريه، او فنيه، او ثقافيه، او تاريخيه، او علميه بشكل دايم، ويحقق عرضها اهدافا تقافيه، او تربويه، او ترفيبيه، ويفتح ابوابه للجمهور في مواعيد ثابته، و يطلق اسم (مجموعه خاصه) علي ما عدا ذلك. سجل الاثار. نشر التقارير العلميه للاعمال الميدانيه، ونشر الابحاث والدراسات المقدمه للهينه عن الاثار والتراث في المملكه. منطقه المسح الاثري التنقيب عن الاثار التصنيف الدراسه الاثريه المتحف السجل النشر العلمي ال Estimates و منظر المرج Saudi Commission for Tourism & National Heritage ٢٥/٣ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده الثانيه: للهينه - في سبيل تطبيق احكام النظام، هذه اللاتحه والاشراف علي تنفيذها - اتخاذ ما يلي: - 1 اصدار القرارات التنفيذيه، والنشرات، والدوريات اللازمه. - ٢ تزويد المرخص له بما يتوافر لديها من خرايط، ومعلومات، واحصاءات، ودراسات، وابحاث لازمه اجراء عمليات المسح الاثري، او التتقيب عن الاثار. - ٣ التنسيق مع الجهات المختصه لتوفير مرافق البنيه الاساسيه اللازمه للمناطق التي -tجري فيها اعمال المسح الاثري، والتنقيب عن الاثار. - ٤ الاشراف والمراقبه الفنيه، والماليه علي الانشطه المرض بها بموجب احكام النظام، وهذه اللاتحه. الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الثاني الترخيص الماده الرابعه: لا يجوز لغير الهييه القيام باي عمل من اعمال المسح الاثري، او التقيب عن الاثار داخل حدود المملكه، او في المناطق البحريه الخاصه لسيادتها، او ولايتها القانونيه؛ الا بعد الحصول علي ترخيص من الهييه. وتقوم الهييه - في الحالات التي تستدعي ذلك - بالتنسيق مع الجهات ذات العلاقه قبل منح التريض. الماده الخاصه: تمنح الهييه التراخيص بناء علي ما تضعه من اولويات تاتصل بالمواقع محل الترخيص، مثل: اهميه الموقع بالنسبه الي تاريخ المملكه، ومدي تعرضه لاخطار البييه، او تاثره بالمشروعات التنميه، وغيرها. الماده السادسه: تنولي الهينه. وفقا لاحكام النظام وهده اللاتحه. اصدار التراخيص التاليه: -1- ترخيص مسح اخري. -2- ترخيص تنقيب عن الاثار. -3- ترخيص مسح اخري، وتنقيب عن الاثار. الماده السابعه: للهينه الترخيص للجامعات، والهينات، والمؤسسات، والجمعيات العلميه الوطنيه، والمنقبين عن الاثار، والبعثات الاجنبيه - سواء بمفردهم او بالاشتراك معها - بالمسح الاثري والتقليب عن الاثار، وفقا للاجراءات التاليه: عربيه اللغه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage 1- يقدم طالب الترخيص طلبه الي الهينه، متضمنا تحديدا للموقع، او المنطقه المراد العمل فيها، والمده المطلوبه، والميزانيه المخصصه، واسماء المشاركين في البعثه، وسيرهم الذاتيه، وخطه العمل موضحه فيها الاهداف المرجو تحقيقها. - يقدم الطلب قبل ابتداء العمل في المشروع المراد الترخيص له بمده لا تقل عن سنه اشهر. - يحال الطلب الي اللجنه العلميه في القطاع لدراسته والتوصيه في شانه. - يرفع رييس اللجنه توصيتها الي الرييس. - في حاله الموافقه، يوقع النايب مع طالب الترخيص اتفاقيه خاصه بعمليه المسح، او التقبب. الماده الثامنه: - يقدم طالب الترخيص طابه علي النموذج المعد لذلك، علي ان يحدد فيه نوع النشاط المطلوب الترخيص به. - يرفق طالب الترخيص بطلبه المستندات التاليه: ا - صوره من اثبات هويته، او الوثايق المثنيه، تصادق عليها الهينه بعد مقارنتها بالاص. ب- شهاده خبره لسابق اعماله. ج- ما يفيد استيفاء التامين اللازم والضمانات المطلوبه. - تقريرا تفصيليا عن خطه العمل المطلوب الترخيص به، ومنطقه الترخيص. ه - تعهدا بتوفير مصادر التمويل للعمل المرخص به. و - اي مستند اخري تحدده الهييه وفقا لطروف كل حاله علي حده. الماده التاسعه: تصدر الهييه الترخيص بعد التحقق من استيفاء الاشتراطات المطلوبه، وارفاق المستندات المؤيده للطلب، وذلك خلال ستين يوما من تاريخ استيفاء الاشتراطات والمستندات والمستندات الموزده للطلب، وذلك خلال ستين يوما من تاريخ استيفاء الاشتراطات والمستندات President Office Visa President Office Visa PresidentOffice الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage وفي حاله عدم اصدار الترخيص خلال تلك المده، او عدم ابلاغ الهييه لطالب الترخيص بقبول طلبه، فان ذلك يعد رفض له. الماده العاشره: 1 - يصدر الترخيص - بقرار من الرييس - لمده لا تزيد عن خمس سنوات - حسب ما تطلبه الاعمال محل الترخيص - وتكون قابله للتجديد، ويشتم علي تاريخ صدوره، ومده سريانه، وبيانات المرخص له، ومنطقه الترخيص، والاشتراطات، والضوابط، والالتزامات التي يتعين علي المرخص له الالتزام بها. ٢- اذا كانت لدي المرخص له الرغبه في تجديد الترخيص بعد انتهاه متده، فعليه التقدم بطلب التجديد الي الهييه قبل سنه اشهر . علي الاقل . من تاريخ انتهاه، علي ان يكون ذلك علي النموذج المعد لهذا الغرض، وان ترافق الطب جميع المستندات المؤيده له. الماده الحاديه عشره: علي المرخص له في حاله تلف الترخيص، او فقده لاي سبب ان يتقدم للهينه بطلب الحصول علي تركيبن اخري بديل، وذلك بعد تقدم جميع المستندات المطلوبه وما يفيد سداد المقابل المالي المستحق. الماده الثانيه عشره: للمرخص له التنازل - كليا او جزييا - عن الترخيص للغير بعد موافقه الهينه الصريحه والخطيه علي ذلك، بشرط ان تتوافر في المتنازل اليه جميع الاشتراطات، والمتطلبات، والضوابط المطلوب توافرها في المرخص له، وبعد تصفيه ما يكون قد ترتب علي المرخص له من غرامات، او تعويضات. ولا يحق للمرخص له في هذه الحاله المطلابه باسترداد المقابل المالي للترخيص، او جزء منه. Y/9 الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الثالث التزامات المرخص له وحقوقه الماده الثالثه عشره: يلتزم المرخص له بما يلي: 1 - تعيين مدير للمشروع من بين اعضاء البعثه، يتولي اعمال الاداره في منطقه الترخيص، ويكون ممتلا للبعثه، ومسول عن تنفيذ جميع التعليمات، والصواب الخاصه بالترخيص، والنشاط المرخص به، علي ان تكون لديه الخبره الكافيه في مجال العمل الميداني في منطقه الترخيص. - ٢- تضمين عضويه البعثه خبراء متخصصين في جميع التخصصات اللازمه لتنفيذ العمل المرخص به. - ٣- التقيد باحكام النظام، وجميع الانظمه واللوايح الساريه في المملكه. - ٤- احترام النظام العام، وعادات المجتمع، وتقافته، وتقاليده. - ٥- التاكيد علي جميع مرافقيه، والعاملين معه بخصوصه لما يخضع له من التزامات. - ٦- تحمل جميع النفقات الماليه لعمل البعثه. - مزاوله النشاط المرضي به في المواعيد، والاماكن المحدده، ووفقا للاشتراطات والمعايير، والضوابط، والمتطلبات التي صدر الترخيص بناء عليها، او التي تحددها الهييه بعد منح الترخيص، وعدم اجراء اي تعديل في هذا الشان دون الحصول علي موافقه كتابيه من الهييه. - ابلاغ الهييه باي تغيير بطرا علي المعلومات، والبيانات التي يقدمها للهييه في شان النشاط المرخص به، والمعدات والمرافق التي يستخدمها، وذلك خلال مده لا تتجاز عشره ايام من تاريخ حدوث التغيير. - استخدام احدت الاساليب العلميه والTقنيه الحديثه في العمل داخل منطقه الترخيجه الموصيات والمركبات Visa Antiquities & Museum Visé President Office Mission for Tourism & National Health ٢٥/٨ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage - ١٠ اتباع الضوابط، والمتطلبات، والثقبات، واساليب التحليل الحديثه في عمليه تحليل المعثورات الاثريه. - ١١ القيام باعمال الصيانه والترميم الاوليه. اولا باول. لكل ما يعثر عليه من اثار ثابته او منقوله، وذلك تحت اشراف مختصين من الهينه. - ١٢ الحصول علي موافقه الهينه علي جميع العاملين لديه في الاعمال المرخص له بها. - ١٣ تدوين نوع الترخيص الصادر له، وتاريخ الموافقه عليه، ورقمه علي جميع وثايق تعاملاته مع الهينه. - ١٤ وضع العلامات الارشاديه والتحذيريه اللازمه، وكل ما يدل علي اسمه، واسم الجهه التي يتبع لها، داخل منطقه الترخيص. - ١٥ تسليم جميع الاثار المنقوله التي يعثر عليها في منطقه الترخيص الي الهينه مباشره. - ١٦ اتخاذ جميع الاجراءات اللازمه لحمايه الاثار الثابته التي يعثر عليها من عوامل التربيه، كالرياح، والامطار، والرطوبه، والحراره، وغيرها. - ١٧ المحافظه علي منطقه الترخيص، وتهيياتها لاستقبال الزوار اثناء تنفيذ العمل. - ١٨ اتخاذ احتياطات الامن، والصحه، والسلامه المهنيه للعاملين في منطقه الترخيص. - ١٩ تزويد الهييه باي معلومات تطبيقها، سواء اكانت احصاييه، او ماليه تتعلق بالنشاط المرخص به، او بالمرافق، او المعدات المستخدمه، او غيرها، وذلك خلال خمسه ايام من تاريخ طلبها. -٢٠- عدم نشر اي معلومات، او بيان، او احصاء - باي طريقه من الطرق - الا بعد الحصول علي موافقه كتابيه صريحه من الهييه، وتنسق الهييه مع داره الملك عبدالعزيز قبل اصدار الموافقه فيما يتعلق بتاريخ المملكه الحديث. - ٢١ تقدم التقارير التاليه الي الهييه: ا - تقرير علمي موتق في شان النتايج الاوليه للاستطلاع والمسح. ب - تقرير اسبوعي عن سير العمل في المشروع. ٢٥/٩ اللينه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage ج- تقرير علمي موسمي يتضمن نتايج كل موس، ويكون مشغوعا بالمخططات، والرسومات، والصور، والضرايح الملوينه، والمسودات، ويسجل خاص ببيان القطع الاثريه التي عثر عليها، وتعبيه البطاقات الخاصه بالسجل، علي ان تقدم جميعها في شكل اقراص مدمجه (CD) او في اي وعاء تخزين للمعلومات تقبله الهييه، بالاضافه الي نسختين ورقتين تكون احداهما مدوله باللغه العربيه والاخري باللغه التي تحددها الهييه. - وضع مخططات لبيان حدود، وموقع العمل، وابعاده، ومعالمه السطحييه والاثار العمرانيه المكتشفه فيه. ه- تقارير نهاييه مفصله في شان نتايج العمل داخل الموقع. - تعبيه الاستمارات الخاصه بالسجل. - عدم ازاله اي من المباني، او الانشاءات التي نفذها في منطقه الترخيص الا بعد اخذ موافقه الهييه. - المساهمه في تدريب منسوبي الهييه في مجال العمل المرخص به، وتمكين المشاركين منهم في البعثه من مباشره جميع الاعمال المكلفين بها، وتقديم تقارير مفصله دوريه عن العمل في منطقه الترخيض، ومتابعه ما يتم اكتشافه، او استخراجهم اثار، والعمل علي تامينها، ورعايتها، والمحافظه عليها، وتوثيها. ٢-٤ تقدم جدول تنفيذي زمني للمشروع، يتضمن مراحل الانجاز المكتبي، والمداني، وتاريخ تقدم التقارير الاولي، والدراسات النهاييه للمشروع. ٢-٥ توفير سجل يومي لمجريات العمل، يردن فيه كيفيه سير العمل يوميا، وتوثيق المكتشفات الحديثه، وتسجيل المعثورات؛ وصفا وتوثيقا وصوره، ويسلم هذا السجل للهينه. ٢-٦ ان يقدم. اضافه الي خطه عمليه. خطه اخري تكميليه يوضح فيها ما ستقوم به البعثه من اعمال الصيانه والترميم للاثار التي تكتشفها، او اي اعمال تناسب تجهيزاتها، وذلك بعد الحصول علي موافقه الهينه، او بالشاركه معها. ٢٧-الالتزام بتنفيذ اي شرط، او متطلب تراه الهينه بعد منح الترخيص. ٢٥/١٠ عطي الوثيقه العامه للسياحه والتراث الحنني Saudi Commission for Tourism & National Heritage الماده الرابعه عشره: علي المXRص له الالتزام - قبل بدء عمليه المسح الاثري، او التتقيب عن الاثار - بما يلي: - الحصول علي التصاريح والموافقات اللازمه من الجهات المعنيه للابدء في عمليه الحفر. - اختيار موقع المسح، او التتقيب داخل حدود منطقه الترخيص. - تعينه الاستمارات الخاصه بالعمل المرخص به. - وضع خطه مناسبه لتنفيذ العمل المرخص به، وعرضها علي القطاع لاقرها. - جمع المعلومات المتوافره عن الموقع المراد المسح، او التتقيب فيه. - توفير المستلزمات، والادوات اللازمه لتنفيذ العمل المرخص به. - ضبط احداثيات الموقع. الماده الخامسه عشره: علي المرخص له الالتزام - خلال عمليه المسح الاثري، او التتقيب عن الاثار - بما يلي: - عمل مسح اولي للموقع. - عمل رفوعات مساحيه للموقع وخارطه كنتوريه. - اجراء بعض المجسات الابتجاريه للتعرف علي الطبقات الاثريه في الموقع، في حاله عدم القيام بها سابقا. - ٤- تقصيم الموقع الي شبكه مربعات، وتوقيع النقطه الثابيه، والخط الثابت. - ٥- تحديد مكان القاء المخلفات الناتجه عن الحفر. - ٦- تنفيذ اعمال المسح، او التقريب باستخدم الطرق الاثريه العلميه، والتقنيه الحديثه المختلفه حسب طبيعه منطقه الترخيص. -٧- اخذ القياسات اللازمه. - ٨- اعداد الرسومات الدقيقه للموقع وما يعشر عليه فيه من قطع اثريه اثناء عمليه التقنيه عن الاثار، والتي تبين المساقط، والقطاعات الافقيه والراسيه. ال Estimates & Documents Vise President Office Commission for Tourism & National Parks 21/11 الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage - 9 - تصوير الموقع الاثري بجميع مربعانه قبل واثاء وبعد عمليه التقيب عن الاثار. - 1. قراعه الطبقات. -1 استخدم اساليب المسح الجيوفيزياني والمسح بالرنين المغناطيسي، او غير ذلك من الاساليب التي تحددها الهينه. - 12- توثيق المعتورات الاثرييه الثانيه والمنقوله في مواقعها وجمع عيناتها بطريقه منظمه. - 13- عدم تجريد الموقع من المعتورات السطحيه. - 14- تحليل المواد الطبيعيه الخام، ودراسه التغييرات السطحيه الجيومورفولوجيه : للوصول الي الاطار البييي الكامل الذي عاصر كل زمن من الازمنه المعروفه. - 15 - اعداد التقارير اليوميه، والاسبوعيه. - 16 - اعداد التقرير الاولي العام، وتقدمه للقطع لنشره في حوليه الاثار السعوديه (اطلال). - 17 - اعداد التقارير النهاييه وعرضها علي القطاع لاقراها. - 18 - اعداد التقرير العام للحفر بعد انتهاء اعمال المسح الاثري، او التقريب عن الاثار، وعرضه علي القطاع لاقراره قبل نشره. الماده السادسه عشره: نتايج العمل الميداني بعد موافقه الهييه، وذلك وفقا للمراحل والضوابط التاليه: المرحله الاولي: يقدم فيها المرخص له تقريرا اوليا يوضح فيه الظواهر المكتشفه، ونتايج قراءه الطبقات، والمعورات الاثريه، وفقترات الاسقرار بالموقع، والاستنتاجات العامه. وينشر هذا التقرير في حوليه الاثار السعوديه (اطلال)، ويمكن نشر التقرير في اصدار مستقل اذا كان حجمه يسمح بذلك، مع نشر ملخص له في حوليه (اطلال). المرحله الثانيه: بعد فيها المرخص له دراسه تخصصيه شامله في شان العمل الميداني، علي ان تنشر في مجلد او مجلدات مستقله بعد اقرارها من القطاع ووفقها لما تقضي به الانظمه. ٢٥/١٢ الهييه العامه للسياحه والتراث الحلني Saudi Commission for Tourism & National Heritage المرحله الثالثه: بعد فيها المرخص له تقريرا نهاييا في شان ما اسفر عنه العمل الميداني و نتايجه، علي ان ينشر في مجلد او مجلدات مستقله بعد اقراره من القطاع; ووفقا لما تقضي به الانظمه. ٢- يRHS لرييس البحث - او من يقوم مقامه - بدراسه الاثار المعثور عليها، والقيام بسمها وتصويرها، ويحفظ للبعثه حقها في النشر العلمي الكامل لاعمال المسح، او التقريب لمده اقصاها ثالث سنوات من تاريخ انتهاه الترخيص، ويسقط بعدها حقها في الاسبقيه في النشر. الماده السابعه عشره: يجوز للمرحص له القيام بما يلي: ١ - فحص الموقع محل الترخيص، سواء بالنسبه الي جميع الاثار، او لناوع معين منها، وذلك وفقا لما يحدده الترخيص. ٢ - فحص الاثار في الموقع محل الترخيص، ودراستها. ٣ - الاطلاع علي ما يلزم من الخرايط والبيانات والاحصاعات - غير السريه - المتوافره لدي الهييه، بعد دفع المقال المالي لها. ٤ - مزاوله اي نشاط علمي، او فني يكون من شانه الكشف عن الاثار في منطقه الترخيص. ٥ - استخدام اي وسيله من وسايل الكشف عن الاثار بعد الحصول علي موافقه الهييه. ٦ - انشاء المرافق الثابته وغير الثابته اللازمه لحفظ الالات والمعدات ومباشره العمل المرخص به، وذلك بعد موافقه الهييه. ٧ - الاستفاده من المواد الطبيعيه المتاحه في منطقه الترخيص، مثل: الرمل والحصي والاحجار وما شابهها - مما لا يدخل في الاملاك الخاصه - في مباشره العمل المرخص به. ٢٥/١٣ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده الشايمه عشره: علي المرض له . في الحالات التي يكون فيها الموقع الصادر في شانه الترخيص مملوكا ملكيه خاصه ثابته بصلت شرعي، او كان لاحد الاشخاص حق انتفاع ثابت شرعا عليه . ان يتفق مع مالك الموقع، او المنقطع به - كتابيا - علي تعويضه تعويضا عادلا. وتقدم نسخه من الاتفاق الي الهينه قبل بدء العمل المرض به علي الموقع. واذا لم يتم التوصل الي اتفاق بين المرض له ومالك الموقع، او المنقطع به حول قيمه التعويض، فتقدر قيمته وفقا للاجراءات المنصوص عليها في نظام نزع ملكيه العقارات للمنفعه العامه، ووضع اليد المؤقت علي العقار. وفي جميع الاحوال، يجب علي المرض له ممارسه حقوقه بالقدر الذي لا يكون من شانه الاضرار بمصالح مالك الموقع، او المنقطع به. التراثات المطلبات ٢٥/١٤ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الرابع الاثار المترتبه علي المسح الاثري والتنقيب عن الاثار الماده التاسعه عشره: تصنف المعثورات الاثريه الناتجه عن اعمال المسح الاثري، او التقيب عن الاثار؛ وفقا للفيات التصنيف التاليه: 1 - تصنيف نوعي: ويتم علي اساس نوع الماده المستخدمه في الصناعه. 2 - تصنيف زمني: ويتم علي اساس تتبع ظهور الاثر في الطبقات الاثره notيقبه، او بحسب الفتره الزمنيه التي يتبع لها اذا كانت معروفه. 3 - تصنيف تقني: ويستخدم بقصد دراسه نوع واحد من الماده الاثريه دراسه تفصيله لمعرفه تطور صناعه هذا النوع من المعتوات. 4 - تصنيف شكي: يتم من خلاله فرز الماده الاثريه ذات الطبيعيه الواحده الي انماط؛ وفقا لتشابه اشكالها. 5 - تصنيف احصايي: ويستخدم في دراسه نوع واحد من الماده الاثريه، ويجري تنفيذه من خلال احصاء خصايص معينه من قطعه اثريه الي اخري، ثم النظر في مقدار الوجود والغياب. 6 - تصنيف زخرفي: يقتضي استخدام العناصر الزخرفيه ذات الطبيعيه الواحده، ويطبق علي النمط الواحد بعد تقنینه من خلال استخدام طرق تصنيف اخري. الماده العشرون: يتبع في شان المعثورات الاثريه والتعامل معها ما يلي: -1 اعداد المذكرات اللازمه عنها في جميع المراحل. -2 اعداد الرسومات الدقيقه لها، والتوثيق الدقيق لموقع العثور عليها. -3 تسجيلها في بطاقات خاصه متوافه مع متطلبات تسجيلها في السجل. المؤسسات التعليميه واللغه ٢٥/١٥ الوثيقه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده الحاديه والعشرون: يجب علي المرحص له اتباع احدث الاساليب الاثريه والثقنيه في تعامله مع المعثورات المكتشفه، ومراعاه حالتها، والمراحل التي مرتب بها حتي تم العثور عليها (مرحله التصنيع، ومرحله الاستخدام، ومرحله تركها) كي لا يترتب علي اي تصرف خاطي تلفها، او تغيير معالمها، او شكلها، او التاثير علي كل، او بعض معالمها الاثريه. الماده الثانيه والعشرون: يعين عند اجراء الدراسه للمعثور الاثري اتباع الضوابط التاليه: 1 - ان تكون دراسته بمعرفه احد اضاء العضه المرخص لها، وفي حاله تعذر قيامه بها لاي سبب، فيقوم ابعادها شخص. ترشعه الهييه. لديه دراريه بالموقع. 2 - ان تتوافر فيمن بعد دراسه عنه خلفيه عن الدراسات السابقه حول المواقع الاثريه في منطقه البحث. ٣- يجب ان يكون القايم بالدراسه باحثا من اخصاب الاجتماع في نوع العثور الاثري. الماده الثالثه والعشرون: - ان يكون الهدف من الاستعاره اما اجراء دراسه علميه لاكثر؛ لبيان اهميه، وتاريخه، وقيمته الاثريه، او اجراء تحاليل مخربيه لا يمكن القيام بها بمعرفه الهييه داخل المملكه لندرتها، او لاحتياجها الي تقنيات حديثه غير متوافره. - ان يصدر بالموافقه علي الاعاره قرار من الرييس بناء علي توصيه اللجنه العلميه في القطاع، وان يبرم اتفاق بين الهييه والمرخص له، تحدد فيه. علي وجه الدقه. مده الاعاره، والاعمال، او الدراسات التي سيتم اجراءها. - ان يتعهد المرخص له. كتابيا: بما يلي: ا - اعاده الاثر بعد انتهاء مده الاعاره، او «المهمه التي تمت الاعاره لاجلها، ايهما اسبق. ب- بذل العنايه اللازمه في سبيل ترميم الاثر، وال محافظه عليه، وعدم التاثير علي قيمته اذا كانت الاعاره بهدف ترميمه. ج - تزويد الهييه باصل الدراسه اللازمه للاثر، وصوره مترجمه منها بالغه التي تحددها الهييه، اذا كانت الاعاره بهدف اجراء دراسه علي الاثر. الماده السادسه والعشرون: للهييه وحدها. دون المرخص له. ان تنتج نماذج حديثه للاثار المكتشفه في الحفاير، او الناتجه عن المسح الاثري؛ وذلك بعد ان يقوم المرخص له بالنشر العلمي عنها، ويجوز للهييه - بعد موافقه الرييس، او من يفوضه - اهداء المرخص له نسخا من تلك النمازج، للهيل ٢٥/١٧ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده السابعه والعشرون: يجوز . بقرار من الرييس، وبعد الحصول علي الموافقات اللازمه . السماح للمرض له بعرض مكتشفاته من الاثار، سواء داخل المملكه، او خارجها. ويحدد القرار الاشتاراتات اللازمه لذلك، ومده السماح. الماده الثامنه والعشرون: اذا لم يغب المرخص له في تجديد الترخيص وكان في حاجه الي المرافق غير الثابته الموجوده في منطقه الترخيص لاستخدامها للغرض نفسه في منطقه اخري حصل علي ترخيص في شانها، فللهينه السماح له بذلك اذا كانت منطقه الترخيص الجديد مطابقه لاشتراطات وضوابط ومعايير منطقه الترخيص السابقه. الماده التاسعه والعشرون: يكون المخص له مسوولا مسووليه كامله عن جميع الاعمال التي يقوم بها هو، او احد تابعيه. اللبج لمتا لمتا لمتا لمتا لمتا لمتا لمتا لمتا الاستعماله والتقنيه الاستعماله والتقنيه الاستعماله والتقنيه الاستعماله والتقنيه Y 0/11 الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الخامس ايقاف المنشط او تعليق الترخيص او الغاؤه الماده التلون: 1- دون الاخلال باي عقوبه نظاميه اخري، للجنه المنصوص عليها في الماده (التسعين) من النظر في صدور قرار منها بايقاف النشاط، او تعليق الترخيص، او الغايه في اي من الحالات التاليه: - اذا ثبت تقدمي المرخص له اوراقا مزوره في سبيل الحصول علي الترخيص. ب- اذا ثبت تقدمي المرخص له - في طلبه، او في الاقرارات، او المستندات المقدمه منه - لبيانات، او معلومات كاذبه، او مصلله. ج- اذا ققد احد اشراطات، او متطلبات الترخيض، ولم يقم المرخص له بتصحيح وضعه خلال المده التي تحددها الهييه. - اذا تنازل المرخص له عن الترخيض للغير - كليا او جزييا - دون موافقه مسبقه من الهينه. ه - اذا ثبث ان في استمرار النشاط المرخص به خطرا علي الامن او الصحه العامه او البييه او السلامه. و - اذا ت ثبت ان المرخص له استولي علي اي اثر من الاثار التي عثر عليها، او انتفه، او هربه، او ساعد علي اي من ذلك. - اذا صدرت في حق المرخص له ثلاثه قارات بايقاف النشاط، او تعليق الترخيص خلال سنه واحده. - اذا صدر في حق المرخص له حكم نهاني في اي من الجرايم المنصوص عليها في نظام. - اذا ارتكب المرخص له فعل غير الافعال المنصوص عليها في هذه الماده من هذه اللاتحه، يستوجب ايقاف النشاط، او تعليق الترخيص، او الغاء. الموصيات والتنميه الموصيات والتنميه الموصيات والتنميه الموصيات والتنميه الموصيات والتنميه المو ص 20/19 الهييه العامه للسياحه والتراث الدولي Saudi Commission for Tourism & National Heritage الماده الحاديه والثلاثون: في حاله صدور قرار من اللجنه بايقاف النشاط، او تعليق الترخيص، فيجب الا تتجاز مده الايقاف، او التعليق سنه اشهر. الماده الثانيه والثلاثون: علي الهييه. عند صدور قرار منها، او من اللجنه بالغاء الترخيص. ابلاغالمرخص له بالParrار علي عنوانه الثابت في ملف الترخيص. الماده الثالثه والثلاثون: يكون المرخص له مسولا عن المخالفات، والجزاءات المنصوص عليها في النظام، وده اللاتحه، وذلك في الحالات التي تصدر فيها الهييه قرارا اييقاف النشاط المرخص به، او تعليق الترخيص، او الغايه، او تعديله. اللبن لمتا لمتا لمتا لمتا لمتا لمتا لمتا لمتا الموزون واللباسيه واللباسيه واللباسيه واللباسيه واللباسيه واللباسيه واللبś الموزون واللبś واللبś واللبś واللبś واللبś واللبś واللبś واللب ś واللبś واللبś واللبś واللبś واللبś واللبś واللبس Yc/Y. الوثيقه العامه للسياحه والتراث الموصلين Saudi Commission for Tourism & National Heritage الفصل السادس اللجنه العلميه الماده الرابعه والثلاثون: 1- تشكل - بقرار من الرييس - في القطاع لجنه علميه دايمه برياسه النايب، عضويه مدير عام مركز البحوث والدراسات الاثريه، وخصه اعضاء - علي الاقل. من الخبراء المختصين السعوديين. 2- تختص الجنه بدراسه ما يعرض عليها من طلبات، وتقارير، ودراسات، وابحاث في شان اعمال المسح الاثري، او التنقيب عن الاثار، والتوصيه بنشر الابحاث والدراسات المختصصه في الاثار، والمتاحف، او موجودات المتاحف، ومستودعات القطاع. - ينوب مدير عام مركز البحوث والدراسات الاثريه عن النايب في رياسه اللجنه في حاله غيابه، ويتعين - في هذه الحاله - عرض توصيات اللجنه علي النايب قبل رفعها الي الرييس. - ٤- تجمع اللجنه كل ثلايه اشهر - علي الاقل - في القطاع، او في المكان الذي يحدده رييسها. - تجمع اللجنه بدعوه من رييسها، ولا يكون اجتمعها صحيا الا ب حضور نصف اعضايها - علي الاقل - بخلاف رييسها، ونتخذ اللجنه توصياتها باغلبيه اصولات اعضايها الحاضرين،})(في حاله تساوي الاصولات، يرجح الجانب الذي صوت معه رييس الاجتماع. ويحدد في الدعوه مكان الاجتماع وزمانه، ويبلغ به اعناوها. - لرييس اللجنه دعوه من يراه لحضور اجتماعاتها من المتخصصين وذوي الخبره للاستيناس بارايم، دون ان يكون لم حق التصويت. - يرفع رييس اللجنه توصياتها الي الرييس خلال مده لا تتجاز خمسه عشر يوما من تاريخ صدورها. الموصوله للسياحه والتنميه Vice President & National Life Saudi Commission for Tourism & National Life ٢٥/٢١ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل السابع الدراسات في مجال الاثار والطاعف الماده الخامسه والثلاثون: 1 - للهينه الموافقه علي اجراء دراسات متخصصه في مجال الاثار والمناتف من قبل الباحثين في هذا المجال، سواء اكانت الدراسه داخل موقع اخري او اكثر، او كانت لماده اثريه مودعه داخل احمد المتاحف، او في مستودعات القطاع. ٢- تقدم الهينه المساعده الممكنه للباحث في اعداد دراسه، وتضمن عدم منح الموافقه لبحاث اخر لاجراء دراسه في الموضوع نفسه الا بعد مرور خمس سنوات من تاريخ موافتها علي الدراسه الاولي. الماده السادسه والثلاثون: - يجب ان تتوافر في كل من يرغب الحصول علي موافقه الهينه علي اجراء دراسه في مجال الاثار، والمتحف المعرفه العلميه، والخبره اللازمه والكافيه التي تؤهله للقيام بالدراسه. - يقدم طالب الموافقه طلبه علي النموذج المعد لذلك؛ مراققه له المستندات التاليه: -
