Dear CEO, Dear CCO, Greetings, Based on the Authority's mandate to regulate, supervise, and monitor the insurance sector pursuant to the Council of Ministers Resolution No. (85) dated 28/01/1445 AH. And with reference to the requirements for identifying the beneficial owner stipulated in the Anti-Money Laundering Law, issued by Royal Decree No. (M/20) dated 05/02/1439 AH and its Implementing Regulations, the Law on Combating Terrorism Crimes and its Financing, issued by Royal Decree No. (M/21) dated 12/02/1439 AH and its Implementing Regulations, and the Beneficial Owner Rules, issued by the Resolution of H.E. the Minister of Commerce No. (99) dated 05/06/1447AH. We would like to inform you that the Ministry of Commerce has launched a query service for the beneficial owner data disclosed by companies through the "Wathiq" platform, which allows access to updated and approved data. Furthermore, the National Center for Non-Profit Sector has launched a technical service to inquire about the beneficial owner data for civil associations and foundations via its website. This aims to enable financial institutions and non-financial businesses and professions to apply due diligence procedures towards their clients. Accordingly, we emphasize the necessity for all licensed persons to promptly undertake the following: * **01** Establish technical integration with the "Wathiq" service to verify the identity of the beneficial owner for companies, taking into consideration all relevant requirements and controls. The Ministry of Commerce must be notified via the platform in the event of an undisclosed beneficial owner or any discrepancies in the information based on due diligence measures, without prejudice to the requirements for reporting suspicious transactions or the provisions of the Personal Data Protection Law. * The procedures for activating the beneficial owner inquiry service through the "Wathiq" platform must be complied with as follows: * Initial Registration: Create an establishment account on the Wathiq platform main page. * Service Activation Request: Send an email to the "Elm" integration team at tr-onb@elm.sa, including: * Completion and signing of the attached Preliminary Data Sharing Form. * Submission of the establishment account details in the Wathiq platform. * Technical Integration Guide: Commercial Register (New Regulations) | Wathiq. * Activation Timeline: Service activation takes (7) business days from the date of receiving the complete request. * Additional Requirement: Obtain a registration certificate in the National Registry for Personal Data Protection from the National Data Governance Platform. * **02** Utilize the service of the National Center for Non-Profit Sector via its website, through the icon (E-Services - Beneficial Owner Information for Civil Associations and Foundations), or via the link: https://es.ncnp.gov.sa/v5/beneficial-own er-disclosure. The Center must be notified via email at AML-CFT.PL@NCNP.GOV.SA if any discrepancy in the data is identified. You are also requested to accelerate the pace of integration with both services to enhance the accuracy and reliability of the information, while notifying the competent authority (the Ministry of Commerce, the National Center for Non-Profit Sector) should you encounter any challenges during implementation. Scope: * Insurance Companies and Insurance brokerage Companies. --- المحترم المحترم السلام عليكم ورحمه الله وبركاته. بناء علي صلاحيات الهييه تنظيم قطاع التامين والاشراف والرقابه به بموجب قرار مجلس الوزراء رقم (85) بتاريخ 1445/1/28ه واشاره الي متطلبات التعرف علي هويه المستفيد الحقيقي الوارده في نظام مكافحه غسل الاموال الصادر بالمرسوم الملكي رقم (م/20) بتاريخ 1439/2/5ه ولايحته التنفيذيه، ونظام مكافحه جرايم الارهاب وتمويله الصادر بالمرسوم الملكي رقم (م/21) بتاريخ 1439/2/12ه ولايحته التنفيذيه، وقواعد المستفيد الحقيقي الصادره بقرار معالي وزير التجاره رقم (99) بتاريخ 1447/6/5ه. نفيدكم بان وزاره التجاره اطلقت خدمه الاستعلام عن بيانات المستفيد الحقيقي من الشركات عبر منصه "واثق" المحدثه والمعتمده، كما اطلق المركز الوطني لتنميه القطاع غير الربحي خدمه تقنيه للاستعلام عن بيانات المستفيد الحقيقي للجمعيات والمؤسسات الاهليه عبر موقعه الالكتروني وذلك لتمكين المؤسسات الماليه والاعمال والمهن غير الماليه من تطبيق اجراءات العنايه الواجبه تجاه عمالها. عليه، نؤكد علي قيام الاشخاص المرخصين بالاتي: * **01** الربط التقني مع خدمه "واثق" للتحقق من هويه المستفيد الحقيقي للشركات، مع مراعاه جميع الاشتراطات والضوابط ذات الصله، واشعار التجاره عبر المنصه في حال وجود مستفيد حقيقي غير مفصح عنه او اختلافات في المعلومات استنادا الي تدابير العنايه الواجبه، دون تعارض مع متطلبات الابلاغ عن العمليات المشتبه بها او احكام نظام حمايه البيانات الشخصيه. * يجب اتباع اجراءات تفعيل خدمه الاستعلام عن المستفيد الحقيقي عبر منصه "واثق" كالاتي: * التسجيل الاولي: يتم انشاء حساب منشاه علي الصفحه الرييسيه لمنصه واثق. * طلب تفعيل الخدمه: ارسال بريد الكتروني الي فريق الربط في "علم" علي العنوان tr-onb@elm.sa، متضمنا: * تعبيه وتوقيع النموذج المبديي لمشاركه البيانات المرفق. * ارسال بيانات حساب المنشاه في منصه واثق. * دليل الربط التقني: السجل التجاري (التشريعات الجديده) | واثق. * مده التفعيل: يستغرق تفعيل الخدمه (7) ايام عمل من تاريخ استلام الطلب الكامل. * متطلب اضافي: استخراج شهاده التسجيل في السجل الوطني لحمايه البيانات الشخصيه من منصه حوكمه البيانات الوطنيه. * **02** ضروره الاستفاده من خدمه المركز الوطني لتنميه القطاع غير الربحي عبر الموقع الالكتروني - ايقونه (الخدمات الالكترونيه - معلومات المستفيد الحقيقي للجمعيات والمؤسسات الاهليه)، او الرابط: https://es.ncnp.gov.sa/v5/beneficial-own er-disclosure وابلاغ المركز عبر البريد الالكتروني AML-CFT.PL@NCNP.GOV.SA في حال تبين وجود اختلاف في البيانات. تسريع وتيره الارتباط بالخدمتين يعزز صحه وموثوقيه المعلومات، مع اشعار الجهه المختصه (وزاره التجاره، المركز الوطني لتنميه القطاع الغير ربحي) عند مواجهه اي تحديات في التطبيق. للاحاطه والعمل بموجبه من تاريخه. مع وافر التحيه. وكاله الشؤون التنظيميه والقانونيه والتنفيذ المرفقات: النموذج المبديي لمشاركه البيانات نطاق التوزيع: شركات التامين وشركات وساطه التامين.
