(40 من 1 من) بستوالتعاونالجزيم Kingdom of Saudi Arabia ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY Office of the Governor المملكه العربيه السعوديه مهدنظ مارك والازتج المردج مكتب المحافظ قرار اداري رقم (٢٤) و تاريخ ٢/٣ ه ١٤١٥ ان محافظ الهيثه بناء علي الصلاحيات المخوله له وبعد الاطلاع علي المادتين الرابعه والخاصه ، والفرقه (٧) من الماده الثالثه عشره من نظام الكهرياء الصادر بالمرسوم الملكي ذي الرقم (٥٦) والاتريخ ٦١٠٦٥. وبعد الاطلاع علي المادتين الرابعه والخاصه من تنظيم الهيه الصادر بموجب قرار مجلس الوزراء الموقر . رقم (١٥٤) وتاريخ ٤٠٥/٠٤ وبعد الاطلاع علي الماده (٤٠٥) من كود النقل، والبادره (DOC4-4) من كود النقل، وبنا علي احكام الرخص ذات العلاقه الصادره من الهييه. ولا تقتضيه المصلحه العامه. يقر ما يلي : اولا : اعتماد قواعد واجراءات تقرير الحوادث والتحقيق فيها وفق الصيغه المرفقه بها القرار. ثانيا : يسري العمل بهذه القواعد والاجراءات من تاريخ صدور هذا القرار. ثالثا : يبلغ هذا القرار لم يلزم لتنفيذ مقتضاه. الله الموفق الله الله الله الله الله الله الله الله الله الله الله الله الله الله الله الله الله الله (40 من 2 مين) المملكه العربيه السعوديه مره شنط عر لمراء الانتجاء الزوج الرقي لكن لكن لكن لكن لكن لكد فواعد واجراءات تقرير الحوادث والتحقيق فيها (٢٣٠ / ٤٢) المصادره بقرار معالي محافظ الهييه ذي الرقم و التاريخ ٢٣ / ٠٥ / ٢٣ (40 ص 3 من) قواعد واجراءات تقرير الوحدات والتحقيق فيها حمده علدلط والكرماء، والتكرح المراء ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY الظهرس ٢ ١. المقدمه والمصلحات والتفسيرات ٥ ١. الهدف ٢. الهدف ٣. التطبيق والمخالفات والتديل ٤. التسهيلات التي تقدم الي الهيه ٥. اداره الحادث ٦. الاداره الحادث ٦. التصنيف ١.٥ ٢٠. الاعمال ذات الصله ٤. الاخطار الاولي بالحادث ٧. التحقيق ٧ ٨. التحقيق ١.٧ ٨. التحقيق ١.٧ ٨. توفيت الحادث ٢.٧ ٢. تانج الحادث ٢.٧ (40 م 4 من) قواعد واجراءات تقرير الحوادث والتحقيق فيها مجتدنطعي الاكرتد والمرجح الدرزوج ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY قواعد واجراءات تقرير الحوادث والتحقيق فيها (7) بموجب الصلاحيات المنوحه لهيثه تنظيم الكهرباء والاناتج المزديج (الهيثه) في المادتين الرابعه والخامسه والفقره (٤٠٥ - ٤٠٥) من الماده الثالثه عشره من نظام الكهرباء، والمداتين الرابعه والخامسه من تنظيم الهيثه، وبناء علي الماده (٤٠٥ - ٤٠٥) من خود النقل، والملاده (DOC4-4) من خود النقل، والملاده (DOC4-4) من خود النقل، والملاده (DOC4-4) من خود النقل، و والملاده (DOC4-4) من خود النقل، و والملاده (DOC4-4) من خود النقل، و والملاده (OCA4-4) من خود النقل، و والملاده (OCA4-4) من خود النقل، و والملاده (OCA4-5) من خود النقل، و والملاده (OCA4-5) من خود النقل، و والملاده (OCA4-5) منтории : اصدرت الهييه القواعد والاجراءات التاليه: المقدمه والمصطلحات والتفسيرات -1 يتم العمل بهده القواعد والاجراءات علي انها قواعد واجراءات تقرير الحوادث والتحقيق فيها ويجري العمل بها اعتبارا من تاريخ ٢٢٠٥/٢٣ يقصد بالانفاظ والعبارات الاتيه المعاني الموضحه امام كل منها - عند استخدامها في هذه القواعد والاجراءات - ما لم يقترض السباق خلاف ذلك : نظام الكهرياء الصادر بالمرسوم الملكي رقم (٥٦/٢٠) وتاريخ ٢٠١٦/١٠ تظهر هييه تنظيم الكهرياء والانتاج المزدج الصادر بقرار مجلس الوزراء رقم (١٥٤١٠) وتاريخ ٤/٥٤١٠ اللايحه التنفيذيه لنظام الكهرياء الخاصه بمهام الهييه الصادره بقرار مجلس اداره الهييه رقم (٢٧/١١/٣) وتاريخ ١٣/١٢/٤ كود النقل الصادر بقرار مجلس اداره الهييه رقم (٢٨/١٦/٣) كود النقل واي تعيديلات تجري عليه من وقت لاخر، واي تعديلات تجري عليه من وقت لاخر، (٢٩/١٨/٤) كود التوزيع الصادر بقرار مجلس اداره الهييه رقم واي تعديلات تجري عليه من وقت لاخر، سنه واحده وفقا للتقويم الميلادي. الجهه او الشخص الذي يقوم بتزويد البضايع او الخدمات لمرخص له بموجب شروط يحددها عقد او تدابير اخري مشابهه، وتشمل جمع الانشطه المتعاقد عليها من الباطن والخدمات الاستثماريه. مكونات الارض وانظمتها الطبيعيه والتي تتضمن الهواء والمناء واليابسه والمواد ال عضويه وغير العضويه والكاينات الحيه. تقرير يتم اعداده من قبل المرخص له وفقا لاحكام الرخصه المنوحه له بحيث يënضمن وصف كامل للحادث وتفاصيل التحقيق وتوصيات منع تكرار ووقع الحادث. التقرير الذي يرسله المرخص له الي الهييه خلال المده المنفق عليها بين الهييه والمرخص له بعد تاريخ اجراء المراجعه المشار اليها في الفقره (٢ - ٢) وذلك الاغلاق الحادث. (٢٠٠٩) (١) مابو (٢٠٠٩) (٢٠٠٩) (٢٠٠٩) (٢٠٠٩) (٢٠٠٩) (٢٠٠٩) (40 م 5 من) قواعد واجراءات تقرير الحوادث والتحقيق فيها محتدنظت علاكماره، الانتج المردوج ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY الشخص المسؤول عن التاكد من اخطار الهييه بالحداث او اعداد تقرير عنه او التحقيق فيه من قبل جهه المرخص له خلال الوقت المحدد والمقدر من الهييه. الانشطه التي يتم القيام بها - او التي يجب القيام بها - من اجل اداره انشطه المرخص له او التحكم فيها بشكل مباشر او غير مباشر. اي حادث كبير تمت الاشاره اليه في الرخص الصادره من الهييه، والذي يشا عن او يرتبط بالاعمال ذات الصله، ويندرج تحت تصنيف الحوادث (1). الشخص المسؤول الاعمال ذات الصله حادث يكون للالفاظ والعبارات المفرفه في تنظيم الهييه واللايحه التفينيه للنظام او كود النقل او كود التوزيع المعاني نفسها في هذه القواعد والاجراءات ما لم يقتض السباق خلاف ذلك. يقتصد بالصلاحات المكتوبه في هذه القواعد والاجراءات بخط بارز فقط المساعده بين ان مصطلحا بعينه قد تم تعريفه في هذه القواعد والاجراءات او في اللايحه التفينيه للنظام او في كود النقل او في كود التوزيع. الخوتيلاع ناتيلاع (٢٠٠٩) الاصدار قواعد واجراءات تقرير الحوادث والتحقيق فيها ٢٠ من ٤ من (40 من 6 من) قواعد واجراءات تقرير الوحدات والتحقيق فيها (ص) ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY الهدف -٢ ان الهدف العام من هذه القواعد والاجراءات هو التاكد من ضبط الحداث والتحقيق فيه بشكل دقيق واخطار الهييه في الوقت المناسب عن اي حداث يتعلق بالاعمال ذات الصله. - سيتهم من خلال الاخطار تتبيه الهييه للحوادث مما يمكنها من القيام بمعاهها بفاعليه، بالاضافه الي ارشاد المرخص له حوال الاستراتيجيات التي تساعد علي منع حدوث الاصابات والامراض والخساير الماديه والاضرار البيييه. تحدد هذه القواعد والاجراءات متطلبات الاخطار القانوني عن الفييات والاصابات المتعلقه بالاعمال ذات الصله والحوادث الخطريه. توفر هذه القواعد والاجراءات ارشادات تتعلق بالحوادث التي ينتج عنها اصابه او خساير ماديه او معنويه شامله تصنيف الحوادث وطريقه الاخطار بها وكتابه تقاريرها والتحقيق فيها. التطبيق والمخالفات والتعديل -3 تطبق هذه القواعد والاجراءات علي اي شخص مرخص له بواحد او اكثر من الانشطه التاليه: • توليد الكهرباء • انتاج المياه المحلاه • توليد الكهرباء (الانتاج المزدوج). • انتاج المياه (الانتاج المزدوج). • انتاج البخار (الانتاج المزدوج). • نقل الكهرباء. • نقل المياه المحلاه. • توزيع الكهرباء. يتم التعامل مع الحوادث التي تQBH بسبب احد موظفي المتعاقد بالطريقه ذاتها حيث يقوم المرخص له يخطار الهييه عنها، كما يتم التعامل معها بالطريقه نفسها التي تعامل بها حوادث المرخص له. وفقا للمادتين الرابعه عشره و الخامسه عشره من نظام الكهرياء، يكون اخفاق المرخص له يخ تطبيق هذه القواعد والاجراءات مخالفه لنظام الكهرياء. هذه القواعد والاجراءات خاضعه للعديل والمراجعه من البيه من وقت لاخر. (٢٠٠٩) الاصدار (1) مابع ٥ من قواعد واجراءات تقرير الحوادث والتحقيق فيها ٢٠ من ٥ من (40 م ن 7 صحه) قواعد واجراءات تقرير الحوادث والتحقيق فيها مجتدنقعالكرمده، والتقج المرزوج ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY -4 يخالا وقوع حادث ما، يجب علي المرخص له اتاحه جميع الوسايل والمعلومات للهبه في الوقت المناسب — كما هو مطلوب من وجهه نظر الهيه - حتي يتم التاكد من امتثال المرخص له لواجباته بموجب هذه القواعد والاجراءات. اداره الحادث -٥ التصنيف ١ -٥ تم تصنيف الحوادث لاغراض التبليغ واعداد التقارير عنها، والتي تعتمد علي مقدار ودرجه الخساير في العمليات، والصحه، والسلامه، والبينه حسبما هو موضع في (1) الملحق تم تصنيف طبيعه الحادث ونوعه اللازم التقرير عنه بناء علي ثلاث فيات رييسه، هي: العمليات - ا كهراء (توليد، نقل، توزيع). تحليه الباء (انتاج، نقل). الصحه والسلامه: وفيات - ب اصابات خطيره. ب-١ المرض الصحي. ب-٢ احدات خطيره. ب - ٤ البييه - ج الاعمال ذات الصله ٢ -٥ تمثل الاعمال التاليه الاعمال ذات الصله ، والتي يجب علي المرضي له مراقبتها : ١ -٢ -٥ جميع الاعمال التي يقوم بها موظفو المرضي له. جميع الاعمال التي يقوم بها موظفو المتعاقف في منشات المرضي له. جميع الاعمال التي يقوم بها موظفو المتعاقف في منشات المرضي له غير المرخصه والتي تم التعاقب بنت تم مراقبتها من قبل المرخي له واداره المتعاقد. يجب اعداد التقارير والتحقيق في جميع الحوادث التي ينتج عنها وفاه احمد موظفي المرخص له او المتعاقد او اي طرف ثالث، والتي تكون بسبب انشطه المرخص له ، او تربط بها باي شكل من الاشكال. قواعد واجراات تقرير الحوادث والتحقيق فيها ٢٠ من ٦ (40 8 9) قواعد واجراءات تقرير الحوادث والتحقيق فيها (٢) متمدنطت جاركوه، الانتجد والدوجد ELECTRICITY & COD-GENERATION REGULATORY AUTHORITY تعتبر جميع الحوادث تعتلق بالاعمال ذات الصله ما لم يبت خلاف ذلك ٢ - ٢ - ٥ للهينه من قبل المرخص له. الاخطار الاولي بالحداث يجب علي الشخص المسول التاكد من اخطار الهييه بجميع حوادث الاعمال ذات الصله التي تحدث او المتوقع حدوثها بسبب: انشطه المرخص له. انشطه التعاقد التي يقوم بها بالنيابه عن المرخص له. يجب علي الفخص المسول اخطار الهييه فورا عن اي حادث خلال مده اقصاها (٢٤) ساعه من وقت و qtوع الحادث وذلك بوساطه اسرع طريقه ممكنه من خلال الاشعار الكتابي او الهاتف او الفاكس او البريد الالكتروني، ويرسل هذا الاخطار الي مكتب نايب المحافظ لشؤون المشتركين ومقدمي الخدمه ، البات (01-2019172) ، الفاكس (01-2019172) ، البريد الالكتروني (vg_cspa@ecra.gov.sa) ويمتر الاخطار قد تم بصوره صحيحه بمجرد استلام المرخص له تاكيد الاستلام من الهييه. علي الفخص المسول التاكيد من انه قد تم الاخطار عن الحداث الي جميع الجهات المعنيه الاخري حسب الانظمه المعمول بها. يجب ان يشتمل الاخطار الاولي بالحداث علي ملخص موجز يشتمل علي الوقت، والاتريخ، والموقع، واصابات الاشخاص واتلاع العادات. والموقع، واصابات الاشخاص واتلاع العادات. والموقع، واصابات الاشخاص واتلاع العادات. والموقع، واصابات الاشخاص واتلاع العادات. والموقع، لاعلاءات المطلبات. والموقع، لاعلاءات المطلبات. والموقع، لاعلاءات المطلبات. والموقع، لاعلاءات المطلب. والموقع، لاعلاءات المطلبات. والموقع، لاعلاءات المطلبات. والموقع، لاعلاءات المطلبات. والموقع، لاعلاءات المطلبات. والموقع، لاعلاءات المطلبات. والموقع، لاعلاءاتالمطلبات. والموقع، لاعلاءاتالمطلبات. والموقع، لاعلاءاتالمطلبات. والموقع، لاعلاءراتالمطلبات. والموقع، لاعلاءاتالمطلبات. والموقع، لاعلاءاتالمطلبات. والموقع، لاعلاءهالمطلبات. والموقع، لاعلاءهالمطلبات. والموقع، لاعلاءهالمطلبات. والموقع، لاعلاءهالمطلب الاصدار (1) مايو ٢٠٠٩ فواعد واجراءات تقرير الحوادث والتحقيق فيها صفحه ٧ من ٢٠ (40 م ن 9 فواعد واجراءات تقرير الحوادث والتحقيق فيها (ع) مدره بره ويد مركوب، الابتج المردوم ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY التحقيق -V التحقيق 1 -V يجب علي الشخص المسول القيام بتحقيق اولي لمعرفه اسباب وقوع الحادث. يجب علي الشخص المسول التاكد من امان الموقع بالاضافه الي التاكد من انه قد تم اتخاذ الاجراءات اللازمه لتحديد اهم اسباب الحادث ومنع تكرار وقعها. يجب علي الشخص المسول او spيخص المرشح من قبل spيخص المسول القيام بالخطوات اللازمه للمحافظه علي الموقع مباشره بعد وقوع الحادث، واذا لم يكن ذلك ممكنا فهليه تسجيل جميع التفاصيل المتقابه بالجادث. يغ حالات الوفيات فانه لا يسمح بالدخول الي مكان وقوع الحادث الا بعد الحصول علي اذن من الجهات المعنيه الاخري، ويجب المحافظه علي المكان والادله باكبر قدر ممكن، حمايه للادله من الضياع او التلف. يجب علي القايمين بالتحقيق جمع وحفظ جميع المعلومات المرتبطه بالحداث قبل وبعد وقوعه، ويتضمن ذلك دون حصر: - تحديد هويه الشهود واخذ اقوالهم. الوثايق والاجراءات المعمول بها وقت وقوع الحادث. مراحل العمليات، حالتها...الخ. الاثار الناتجه عن المعدات المتعلقه بالحادث. وضع المعدات والاشخاص. توثيق اجراءات الطواري التي تم القيام بها مباشره بعد وقوع الحادث. الوقت. -ز الاحوال الجويه السايده. اي معلومات اخري ذات صله مثل وضع المعدات واحمالها ... الخ. يمكن اجراء التحقيق بالتعاون مع اي من المتعاقدين المشتركين في الحادث، ومع ذلك يمكن ان يقوم المتعاقد اجراء تحقيق منفصل وفقا لاجراءاته المعمول بها. توقيت التحقيق ٢ -٧ يجب ان يتم القيام بالتتحقيقات في اقرب وقت ممكن بعد وقوع الحادث. (٢٠٠٩) الاصدار (1) مايو ٢٠ من ٨ صفحه ٤ قواعد واجراءات تقرير الحوادث والتحقيق فيها (40 من 10 قواعد واجراءات تقرير الحوادث والتحقيق فيها الشريه والابترج المزج ELECTRICITY & CO-ENERATION REGULATORY AUTHORITY ناتج التحقيق ٢ -٧ ولزياده الفايده فانه يتم توزيع نتايج التحقيق علي جميع الموظفين وذلك من خلال: الاجتماعات الداخليه. - التدريب. الشرات ومن اجل زياده الفايده والمساعده علي عدم تكRAR وقوع الحادث فانه يتم ابلاغ جميع المتعاقدين بنتايج التحقيق والتوصيات المتعلقه بالحداث. تحقيق الهيه ٢ - ٣ يجوز للهييه القيام اجراء تحقيق خاص بها في حال تطلب الوقف ذلك او اذا كان تقرير التحقيق الكامل المرسل من قبل المرخص له لا يفي بمعابير ومتطلبات الهييه. التحقق لنا تثني (٢٠٠٩) الامصدار (1) مايو ٢٠٩ صنحه ٩ فواتعد واجراءات تقرير الحوادث والتحقيق فيها (40 من 11 مبن) فواعد واجراءات تقرير الحوادث والتحقيق فيها علددزق كرام والابتج المرادج ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY التقارير -٨ تقارير الحوادث 1 -٨ يجب ان يقوم الشخص المسؤول بالاخطار عن جميع الحوادث وفقا لما يلي: - يقوم المرخص له خلال يومي عمل من تاريخ وقوع الحادث بتسليم الهيثه نسخه كامله من نموذج التقرير الاولي للحادث (الملحق ٢) ، ويرسل التقرير الي مكتب نايب (٠١-٢٠١٩١٧٢) المحافظ للشؤون المشتركين ومقدمي الخدمه ، الباتف (٠١-٢٠١٩١٧٢) .(vg_cspa@ecra.gov.Sa) ٢٠١-٢٠١٩١٧٣) الفاكس - علي المرخص له ارسال نسخه كامله من تقرير تحقيق الحادث (الملحق ٢) الي الهييه خلال عشرين (٢٠) يوم عمل من تاريخ وقوع الحادث او اي فتره قصر تحددها الهييه ، ويرسل التقرير الي مكتب نايب المحافظ لشؤون المشرون المقدمي الخدمه ، المواقف (٢٠١-٢٠١٩١٧٣) ، الفاكس (٢٠١-٢٠١٩١٧٣) (Vg_cspa@ecra.gov.sa) (جمد) . (٢٣ رقم) بحسب طبيعه الحادث، فانه يجوز للهيثه ان تطلب من المرض له تزويدها بمعلومات اكثر تفصيلا او تختلف عن تلك المعلومات المطلوبه وفقا للفقرتين (ا) و (ب) من الفقره (1) اعلاه. الاجراءات والتوصيات يجب علي المرضي له العام علي ايجاد نظام داخلي يسمح بمناعه تنفيذ اي توصيات ١ - ٢ - ٨ ينتهي اليها التحقيق. يجب علي المرضي له القيام بمراجعه حادث الوفاه او اي حوادث اخري تحديدها الهيه خلال مده يتم الاتفاق عليه بين الهيه والمرخص له للتاكد من انه قد تمت معرفه الندروس المستفاده من الحادث وتنفيذ الاجراءات التصحيحيه اللازم اتخاذها لمنع تکرار وقوع الحادث. يجب علي المرضي لم ارسال التقرير النهايي للهينه بجميع الاجراءات الموصي بها والمتعلقه بالحادث خلال مده يتم الاتفاق عليهها بين الهيثه والمرخص لم بعد تاريخ المراجعه المشار اليها في الفقره (٢ - ٢ - ٨) يجب ان يتضمن التقرير النهايي علي الاقل ما يلي: - 1 - ملخص بالحادث مراجعه للاسباب الاساسيه والثانويه. مراجعه القضايا الرييسيه والاجراءات الوقاييه المتخذه. - جدول يوضح التوصيات والاطراف المكلفه بتنفيذها والاجراءات المتخذه حيال كل منها. (ويقصد باستقرار النظام في هذه الفقره: قدره وحدات - او محطات - التوليد علي البقاء في وضع المزمنه مع باقي منظومه الكهرباء في اثناء او بعد وقت قصير من حدوث اضطراب للنظام او تغيرات مفاجيه في الاحمال او التوليد او حدوث قصر كهربايي علي خطوط النقل. Introduction 1.1 These Rules & Procedures may be cited as The Incident Reporting and Investigation Rules & Procedures and shall come into force on 18/05/2009 1.2 The following words and expressions shall have the following meanings in these Rules & Procedures unless the context otherwise requires: "The Law" The Electricity Law issued under the Royal Decree No. (M/56) dated 20 Shawal 1426H. "The Charter" Founding Charter of the Electricity and Co-generation Regulatory Authority. Issued by council of ministries decision No (154) dated 4/5/1428H. "Implementing Regulations" The implementing regulations of the Law issued by the Board decision No (3/11/27) dated 15/4/1427H. "The Grid Code" Saudi Arabian Grid Code issued by the Board decision No (3/16/28) dated 01/06/1428H and any modifications to it thereafter. "The Distribution code" The Distribution code issued by the Board decision No (4/18/29) dated 02/05/1429H and any modifications to it thereafter. "Year" calendar year, according to the Gregorian Calendar "Contractor" An entity which provides goods or services to licensee under terms specified in a contract or similar arrangement and includes all sub-contracted activities and consultancy services. "Environment" The components of the earth and its interacting natural systems, which includes air, land, water, organic and inorganic matter and living organisms. "Incident Investigation Report" A report which is prepared by the licensee pursuant to the issued license conditions. An incident investigation report include a complete description of the incident, detail from the subsequent investigation and recommendations for avoiding reoccurrence. "Final report" A report send by the licensee to the Authority within the period agreed between the Authority and licensee in accordance to clause (8-2-2) to close out the incident. "Work Related" Those activities for which management controls are in place, or should have been in place. "Incident" Any major incident as referred to in the licenses issued by Authority which arises out of, or in connection with a work related activity and is of class specified in Appendix A1. 1.3 The terms defined in the Charter, Implementing Regulations, Grid Code or Distribution Code shall have the same meaning in these Rules & Procedures, unless the context otherwise requires. 1.4 The bolding of the term in these Rules & Procedures is intended only to assist in identifying that a term has been defined in these Rules & Procedures, the charter, Implementing Regulations, Grid code or Distribution code. Purpose 2.1 The main purpose of these Rules & Procedures is to ensure the control and investigation for incident in precise manner and timely notification to the Authority of any incidents that have occurred during licensee's work related activities. 2.2 The notification will alert the Authority to individual incidents, enabling the Authority to target its activities effectively and to advise licensee on strategies to help prevent injuries, ill-health and accidental loss and environmental damage. 2.3 The Rules & Procedures outline the requirements for statutory reporting of notifiable Work-related fatalities, injuries and Dangerous Occurrences. 2.4 The Rules & Procedures provide guidance for the classification, notification, investigation and reporting of incidents which result in injury or illness, or damage (loss) to assets, the Environment or licensee reputation. 3. Enforcement, Violations and Amendment 3.1 These Rules & Procedures shall apply to all licensee undertaken by licensed for one or more of the following activities: - Power generation. • Desalinated water production. • Power generation. (Co-generation) • Water production .( Co- generation ) • Steam generation. (Co-generation) • Electricity transmission. • Desalinated water transmission. • Electricity distribution. 3.2 For the purposes of notifying incidents sustained by, or caused by, contractor employees, these incidents are to be treated in the same manner as licensee's incidents and shall be reported to the Authority by the licensee. 3.3 Pursuant to Article (14) and (15) of the Law, failure of any licensee to comply with these Rules & Procedures is contrary to the Law. 3.4 These Rules & Procedures are subject to modification or revocation by the Authority at any time and from time to time. 4. Facilities to be afforded to the Authority For all incidents, licensee shall make available to the Authority, in a timely manner all access and information, as required in the opinion of the Authority, for ascertaining whether they comply with their duties under these Rules & Procedures. 5. Electricity – generation, transmission, distribution; ii. Desalinated water – production, transmission (b) Health and safety: i. Fatality; ii. Major injury; iii. III- health; and iv. Dangerous occurrences; (c) Environment. 5.2 Work-Related Activities 5 The following are considered to be work-related activities, for which licensee controls should be in place: (a) All work by licensee's personnel; (b) All work by licensee's contractor personnel on licensee's premises; and (c) All work by licensee's contractor personnel on non-licensee's premises for which it is concluded that both licensee and contractor management controls are in-place. 5.2.2 All fatal incidents involving licensee's employees, contractor employees or third parties that are, or may be related in any way to licensee's business shall be investigated and reported. 5.2.3 All incidents are considered work-related until proven otherwise to the satisfaction of the Authority. 6. Initial Notification The Incident Reporting & Investigation Rules & Procedures Page 6 18/05/2009 Version (1) (40 28 28 The Incident Reporting& Investigation Rules & Procedures مجنده تطبيق المركبه واللار والزيت ELECTRICITY & CO-GENERATION REGULATORY AUTHORITY 6.1 The responsible person shall ensure that all work-related incidents, which resulted or may have resulted from: (a) Licensee's activities; or (b) Contractor activities on behalf of the licensee is reported to the Authority. 6.2 The responsible person shall immediately inform the Authority directly of any incident at least within (24) hours of incident occurring by the quickest practicable means via written notification or telephone or fax or e-mail. This notification shall be sent to the Vice Governor for Consumers & Service Providers Affairs, telephone (01-2019172), fax (01-2019173), e-mail (vg_cspa@ecra.gov.sa). 6.3 The responsible person is responsible for insuring all other relevant Authorities are notified of any incident, applicable by law. 6.4 The initial notification shall include a brief summary of the incident including the time, location, injuries to people and damage to equipments. 7. Investigation The Incident Reporting & Investigation Rules & Procedures Page 7 18/05/2009 Version (1) (40 分 29 分) The Incident Reporting& Investigation Rules & Procedures المراعييات والموصوف الموصوف الموصوف الموصوف الموصوف الموصوف الموصوف الموصوف 7.1 Incident Investigation 7.1.1 The responsible person shall initiate an investigation to ascertain the causes and reason for the incident occurring. 7.1.2 The responsible person, shall ensure that the site is made safe and that action has been taken to identify the most obvious cause(s) of the Incident and protect against recurrence. 7.1.3 The responsible person, or person nominated by the responsible person, shall take steps to preserve the site immediately after the incident and, if this is not possible, to make records of all relevant details. 7.1.4 In the case of fatalities, the scene must not be disturbed until permission is obtained from the Relevant Authorities. The scene and all evidence shall be preserved to prevent deterioration as much as possible. 7.1.5 The investigation shall collect and preserve information prior to the site or operation being disturbed or restarted. This will normally include: (a) Identification of witnesses and taking evidences; (b) Documentation and procedures in operation at the time of the incident; (c) Phase of operations, process condition, etc; (d) Markings left by equipment involved; (e) Position of persons and equipments; (f) Documentation of emergency response procedures immediately following the incident; (g) Time of day; (h) Prevalent weather conditions and. (i) Any other related information such as equipments and there loud, etc. 7.1.6 The investigation shall be conducted in cooperation with any contractors involved in the incident. However, a contractor can conduct a separate investigation according to its own procedures and processes. 7.2 Investigation Timing The investigation must take place as soon as practicable after the incident. Reports 8.1 Incident reports 8.1.1 All incident shall be reported by the responsible person in a accordance with the following: a) Within two business days of the occurrence of an Incident, a licensee shall submit to the Authority a completed version of the form in Appendix A2 – Initial Incident Reporting Form to the office of Vice Governor for Consumers & Service Providers Affairs, telephone (01-2019172), fax (01-2019173), e-mail (vg_cspa@ecra.gov.sa). b) A licensee shall submit a complete Incident Investigation Report within (20) Business days of the occurrence of an incident or any other shorter period as decided by the Authority to the office of Vice Governor for Consumers & Service Providers Affairs, telephone (01-2019172), fax (01-2019173), e-mail (vg_csna@ecra.gov.sa). This report shall include the elements listed in Appendix A3. 8.1.2 In the light of the incident, the Authority may call for the furnishing of information which is more extensive or different from that required to be prepared to the Authority under Clause 8.1.1 a and b. 8.2 Actions and Recommendations 8.2.1 The licensee must ensure that a system is in place for tracking any actions highlighted from the investigation. 8.2.2 The licensee shall undertake a review during a period agreed between the Authority and the licensee of a fatality or any incident identified by the Authority, to ascertain if the main learning points and corrective actions taken to prevent recurrence of an incident have been implemented. 8.2.3 The licensee shall, within the period agreed between the Authority and the licensee following the review, submit to the Authority a close-out report of all the recommended actions related to the incident. 8.2.4 As a minimum, the final close-out report shall contain: (a) a summary of the incident; (b) a review of the main and contributory causes; (c) a review of key issues identified and preventative action taken and (d) a table listing original recommendations, action parties and action taken to close-out each point. (e) Basic information regarding equipments to the incident occurring. Records 9.1 The licensee shall keep a record of (a) any incident which is required to be reported under these Rules & Procedures; and (b) other particulars as may be required for the purposes of demonstration that any approved means of reporting under these Rules & Procedures has been complied with. 9.2 Records shall be kept at the licensee usual place of business. 9.3 The records of the incident shall be kept for at least six years from the date of the incident. 9.4 The licensee shall send to the Authority from the records all information required to be kept as the Authority may require from time to time. 10. The Language 10.1 These Rules & Procedures are prepared in both the Arabic & English languages. To extent of any inconsistency between the two, the Arabic text shall prevail.
