المصادر بالمرسوم الملكي رقم م/١ و تاريخ ٢/٢١ وبنا علي مقتضيات العمليه اعامه. يشر ما يل ماده (1) شمر الحلمه التنفيذيه لنظام السجل التجاري بالMIGHه المرتفه. ماده (2) يشمر هذا القراء في المريده الرسميه ويعمل من تاريخ نشره (ن) وزير التجاره 1.07 بستي لزماركم الروت م التاريخ المشفوعات : الموزه المطعميه وزاره الحنجاره الرييس ١٩٩٤ الماده الاولي: تحدد دايره اختصاص مكتب السجل التجاري طبقا للملحق رقم (1) المرفق بهذه اللاتحه ويجوز يقرار من وزير التجاره انشاء مكتب اخري وتعديل دايره اختصاص المكات القايمه. الماده الثانيه: تعد وزاره التجاره في كل مكتب من مكتب السجل التجاري مسجلا لتسجيل التجار والشركات في دارجه اختصاص كل مكتب، ويجوز ان تتعدد السجلات بتعدد المدن الداخله في دايره اختصاص المكتب، ويتم ترقيم صفحات كل سجل بارقام سلسله، ويكون لكل منها رمزا خاصا بها كما يكون للمنشات بحسب شكلها النظامي رمزا مميزا. ويحق لوزاره التجاره استخدام الحاسب الالي في التسجيل وذلك بمراعاه الاحكام الوارده بالفرقه السابقه. الماده الثالثه: تحر طليات التسجيل وكذلك طلبات التديل وطلبات ضطب التسجيل المنصوص عليها في التظام علي الاستمارات التي تعد لهذا الغرض ويجب ان يرق بكل طلب المستندات المؤيده له وان تكتب بخط واضح وان تقدم من الاشخاص الملكين يتقدمها طبقا لل نظام ويجوز لم ان ي كلوا عنهم غيرهم في ذلك بتو كيل رسمي خاص او عام ينص فيه صراحه علي سلطه الوكيل في تقدمي اي من الطلبات المشار اليها. ويحفظ اصل التوكيل او صوره منه مع اصل الطلب يمكن السجل التجاري. الماده الرابعه: يجب علي مستولي اداره فروع ومكاتب الشركات الاجتماعيه الممرخها بفتاحها في المملكه ان يرفقوا بطلب تسجيل الفروع او المكاتب صوره من قرار الترخيم يافتاح الفرع او المكتب وحيويه ان يختصل الوثايق المؤيده لامستين الشركه مصدقه من جهات الاجتماعات م动静ات ترجمه عزينه متعدده ويجب ان يختصل طلب التسجيل علي البيانات المنصوص عليه في الماده الثالثه من نظام بيانات وافيه عن الفرع او المكتب تشتمل علي الاخص علي ما يلي: الامس التجاري للفرع او المكتب وعنوانه الفرديه والشركات وفروعها البيانات الوارده في المادتين الثانيه والثالثه من نظام كما يجب ان يبين فيها سلطات المدير في الاداره او التوقع وعلي الخاص التصرفات والعقود والمحاسبات المحوله للمدير او الاشخاص الذين لمح توقع سواء من حيث نوعها او قيمتها وكذلك التصرفات والعقود المحظور عليهم مباشرتها ان وجدت. الماده السادمه تقدم كافه الطبات المشار اليها في المواد السابقه الي الموظف المختص بمك السجل التجاري وعليه ان يتحقق من توافر كافه الشروط المضمون عليها في النظام بالنسبه لكل طلب مؤشر علي الطلب بتاريخ تقدمه وبقول الطبات المستوفيه للشروط ورفض الطبات الاخري مع ذكر اسباب الرفض كل ذلك مشروعا بWOIEه وعليه في كل حاله ان يتحفظ باصل الطلب يمكن السجل التجاري المختص. الماده السابعه: علي مكتب السجل التجاري تيجيل بيانات الطبات المقوله بالسجل المعد لهذا الغرض واصدار شهاده يذلك من اصل وصوره وتسليم الاصل لصاحب الشان ويحفظ بالصوره في مكتب السجل التجاري. الماده الثامنه: في حاله التاشير بيانات من شانها تغير البيانات المقيده في السجل يجري تدوين البيانات الجديده من واقع الطلب المقدم من صاحب الشان واصدار شهاده تسجيل تضمن البيانات المعدله. الماده التاسعه: يتم تحصيل الرسوم المستحقه من صاحب الشان بعد قول طلب التسجيل او التعديل، بتحرير اصنالات الاسلام علي النودح المعد لذلك من ثلاث صور برقم مسلس واحد ويزود ضناخ الشان بصور دتين منها ليرفق احدها بالطلب، وتقوم مكتب السجل ابات رقم الايصال بشهاد التسجيل، وتعتبر المده المستحق عنها الرسم هي مده صلاحيه الشهاده. بسم المله علي الرت التاريخ المشغوطات : المله العشريه وزاره الدخمار الرباحي ١١١٦٥ الماده العاشره: يصدر مكتب السجل التجاري المختص شهاده بineaوب التسجيل من اصل وصوره وفقا للنودج المعد لذلك علي ان يبين بالشهاده تاريخ حصول الشطب وسبيه ويسلم الاصل لصاحب الشان ويحظ بالصوره في مكتب السجل التجاري. الماده الحاديه عشره: علي مكاتب السجل التجاري التاشير بالاحكام والاوامر المنصوص عليها في الماده العاشره من النظام ويكل جزاء يوقع علي احد المقيدين بالسجل التجاري في المضحه الخاصه به بين ملخص هذه الاحكام والاوامر والمخالفه ومقدار الجزاء وتاريخ صدور القراء به وتاريخ تبلغه للمخالف و تاريخ تقديم التعلم ان وجد ورقم وتاريخ القرادر الصادر من وزير التجاره بهذا الشان وملخصه وتاريخ تنفيذ الجزاء. وعلي مكتب السجل التجاري الاحتفاظ بالاحكام والاوامر المطار اليها بالملف الخاص بالاجر. الماده الثانيه عشره: في حاله عدم الاستدلال علي التاجر او الشركه في العنوان الموضع بالسجل التجاري يعتبر الاخطار المنصوص عليه في الفقره الثانيه من الماده السابعه من التظام والذي تم علي هذا العون صحيها ومنتجلا لاتاره التقامه في حقهها، ويكون لمكتب السلج التجاري شطب التسجيل بعد التحقق دخول المجال التجاري وما ت Ubع من مخابزن او مسوعدات واجراء التقتيض متي لزم لامر وعلي صاحب المحل او المسل ل عنه ان يقدم جميع التسهيلات لتحقيق هذه الغايه. بشر المله علي الرقيم: الطرفيه وزاره الحنجاره الموفته وصاحب المصل او المفوض عنه، ويتم رفع المحضر الي اللجنه الملكه طبقا لنص الماده الساده عشره من نظام، وللجنه الاستجابه باهل الخبره في تقدير راي مال المحل ولها في مسيل ذلك الاعتداد بالقوايم الماليه التي يعدها التاجر عن نشله التجاري والبيانات الوارده في دفاتره كما يجوز لها الرجوع الي مصلحه الزكاه والدخل لمعرفه راي مال. الماده السابقه عشره: يلترم الموقف المختص يضبط المخالفات عند تنفيذ الاجراءات المشار اليها بمواعد السلوك الحسن والخلاقal الحмиده والاباب العامه، ولا يجوز له زياده المحلات التجاريه لاغراض الضبط في غير اوقات عملها اليومي. الماده الثامنه عشره: يستمر العمل بقرار وزير التجاره رقم (١٥١) و تاريخ ١٨/٨/١٧ م فمما لا يعارض مع احكام نظام السجل التجاري و منها اللاحبه، كما تلفي القرارات والتعليمات التي تتعارض مع احكام هذا التطام.
