الهييه العامه للسياحه واللوات الوطني Saudi Commission for Tourism & National Heritage (7) رييس الهييه قرار مجلس الاداره رقم (٨/٨/٥١٤٣٦) ان مجلس اداره الهييه العامه للسياحه والتراث الوطني، وبناء علي الصلاحيات المخوله له نظاما، وبناء علي الماده الثالثه والتسعين من نظام الاثار والمناتخف والتراث العمراني الصادر بالمرسوم الملكي رقم (م/٣) وتاريخ ١٤٦٣/٩ وبعد الاطلاع علي محضر مجلس اداره الهييه لجسته الثامنه والثلاثين التي عقدت بتاريخ ١٤٣٦/٨/١٠ يقر ما يلي: اولا: اصدار لانحه الاتجار بالاثار المنقوله وقطع التراث الشعبي وتبادلها واعارتها، بالصيغه المرفقه لهذا القرار. ثانيا: ينشر هذا القرار واللايحه العامه للسياحه والتراث الوطفي Saudi Commission for Tourism & National Heritage الفصل الاول تعريفات واحكام عامه الماده الاولي: تكون للكلمات، والعبارات التاليه. اينما وردت في هذه اللاتحه. المعاني المبينه امام كل منها، ما لم يقتص السباق معني اخري: الهينه العامه للسياحه والتراث الوطني. الهينه: رييس الهينه. الرييس: نظام الاثار والمتاحف والتراث العمراني. النظام: لجنه النظر في مخالفات احكام النظام، وايقاع العقوبات الوارده فيه. الجنه: قطاع الاثار والمتاحف. القطاع: القطع الاثريه التي صنعت في الاصل؛ لتكون بطبيعتها منفصله عن الارض، او الاثار المنقوله: عن الاثار التابيه، والتي يمكن تغيير مكانها، كالمنحوتات، والمسكوات، والكتابات، والحي، وادوات الزينه، والقطع التراثيه التي تشكل قيمه وطنيه من حيث طابعها التاريخي، او العلمي، او الجمالي، او الفني، او التقليدي، او قدم الاستخدام. جميع ما تتولي الهينه انتاجه، او الترخيص بانتاجه. الاستساخا للقطع الاثريه وقطع التراث الشعبي، سواء اكانت مطابقه لمواصفات القطع الاصليه، او مغابره لها في بعض تفاصيلها. قطع التراث الادوات والقطع التي صنعها الانسان، او استخدامها في العصور المتاخره في اي منطقه من مناطق المملكه لتسير اموره المعيشيه، من مطعم، وملبس، ومسكن، وتعليم، ودفاع عن النفس، ومحافظه علي صحه البدن، وادوات ترويحيه. تحديد درجه اهميه الاثر المنقول، او قطعه التراث الشعبي، وذلك وفقا لقيمه اي منهما التاريحيه، او الثقافيه، او الفنيه، او العلميه، او الوطنيه. التصنيف: الترخيص: الشعبي. ٢٢/٢ العربيه الوثيقه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage كل شخص طبيعي، او اعتباري حاصل علي ترخيص ساري المفعول من الهينه للاتجار بالاثار المنقوله وقطع التراث الشعبي، وفقا لاحكام نظام وهذه اللاتحه. المرخص له: الماده الثانيه: تتولي الهينه في سبيل تطبيق احكام نظام، واهيه اللاتحه، والاشراف علي تنفيذها؛ ما يلي: - اصدار القرارات اللازمه في شان الاتجار بالاثار المنقوله، وقطع التراث الشعبي. تحديد مواصفات، واشتراطات المواقع التي يرخض فيها بالاتجار بالاثار المنقوله، وقطع التراث الشعبي. - توفير ما يلزم من معلومات، واحصاءات، ودراسات، وابحاث خاصه بالاثار المنقوله، وقطع التراث الشعبي المسموح بالاتجار بها، وTNSق الهينه مع داره الملك عبد العزيز فيما يتعلق بتاريخ المملكه الحديث. - ٤- الاشراف، والمراقبه الفنيه علي المواقع، والانشطه المرض بها. - ٥- تحصيل المقابل المالي، والغرامات المفروضه وفقا لاحكام النظام. - ٦- تحديد الاجراءات واعداد النماذج اللازمه لتنفيذ احكام النظام وهذه اللايحه. الماده الثالثه: ينشي القطاع سجلا تقيد فيه معلومات الخبراء المثمنين المتخصصين في الاثار المنقوله وقطع التراث الشعبي، علي ان يكونوا من الموث الموث الموث الموث الموث Yr/Yr الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الثاني التراخيص الماده الرابعه: لا يجوز لاي شخص طبيعي، او اعتباري ممارسه نشاط الاتجار بالاثار المنقوله، وقطع التراث الشعبي، او اقامه مزاد بيع الاثار المنقوله، وقطع التراث الشعبي، او ترميم الاثار المنقوله لاغراض تجاريه؛ الا بعد الحصول علي ترخيص من الهينه. الماده الخامسه: تتولي الهينه - وفقا لاحكام النظام وهذه اللاتحه - اصدار التراخيص التاليه: - 1 ترخيص اتحار بالاثار المنقوله. - 2 ترخيص اتحار بقطع التراث الشعبي. - 3 ترخيص اقامه مزاد بيع الاثار المنقوله، وقطع التراث الشعبي. - 4 ترخيص ترميم الاثار المنقوله لاغراض تجاريه. - 5 ترخيص نسخ الاثار، او صنع نماذج لها لاغراض تجاريه. وبجوز لطالب الترخيص الحصول علي اكثر من ترخيص في وقت واحد؛ متي ما توافر فيه الاشتراطات والمتطلبات اللازمه. الماده السادسه: - 1 يقدم طلب الترخيص الي الهييه علي النموذج المعد لذلك، علي ان يحدد الطلب نوع النشاط المطلوب الترخيص به، وموقع مزاولته. - 2 يرفق طالب الترخيص بطلبه المستندات التاليه: ا - صوره من ا ثبات الهويه تصادق عليه الهييه بعد مقارنتها بالاصل، او صوره مصدقه من سجله التجاري علي ان يتضمن نشاط التجار. ب- تقريرا مفصلا عن خطه العمل التي ينوي تنفيذها، وموقع مزاولته. - ما ي ثبت سداد المقال المالي للترخيص. الصامي ٢٢/٤ الهييه العامه للسياحه والتراث والطيي Saudi Commission for Tourism & National Heritage د- ترخيص البلديه والدفاع المدني ساري المفعول. ه - استيفاء جميع الاشتراطات الاخري والمستندات اللازمه والتي تري الهييه ضرورتها بحسب كل حاله علي حده. الماده السابعه: تصدر الهييه الترخيص بعد التحقق من استيفاء الاشتراطات المطلوبه، وارفاق المستندات المؤيده للطلب، وذلك خلال تسعين يوما من تاريخ استيفاء تلك الاشتراطات والمستندات. وفي حاله عدم اصدار الترخيص خلال تلك المده، او عدم ابلاغ الهييه لطلب الترخيص بقبول طلبه، فان ذلك يعد رفض له. الماده الثامنه: - 1 يصدر الترخيص بقرار من الرييس، ويشتمل علي تاريخ صدوره، ومده سرايانه، وبيانات المرخص له، وموقع الترخيص، والاشتراطات والضوابط والالتزامات التي يتعين علي المرخص له الالتزام بها. - 2 يصدر الترخيص لمده ثالث سنوات، ويجوز تجديده بعد انتهاه مدته، وذلك لمده او مدد مماليه، او لمده لا تقل عن سنه. وعلي المخصص له التقدم بطلب التجديد قبل شهرين - علي الاقل - من تاريخ انتهاه الترخيص، علي ان يكون ذلك علي النموذج المعد لهذا الغرض، وان يرفق بطلبه جميع المستندات المؤيده له. الماده التاسعه: - يجوز للمرحص له. بعد موافقه الرييس، بناء علي تقرير يعرض عليه من القطاع - 1 التنازل عن الترخيص للغير، بشرط ان تتوافر في المتنازل له جميع الاشتراطات والمتطلبات والصوابط المطلوبه في المرخص له، وبعد تصفيه ما علي المرخص له من التزامات تجاه الهينه. بجوز للمرحص له التنازل عن بعض اجزاء الموقع محل الترخيص للغير في حاله ثبوت عدم حاجته اليها، شريطه ان تتوافر في المتنازل له جميع الاشتراطات، والمتطلبات، والضوابط المطلوبه في المرخص له، ولا يحق له في هذه الحاله المطلابه باسترداد المقابل المالي للترخيص، او جزء منه. الفرح 21/5 الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده العاشره: علي المزخص له، في حاله تلف الترخيص، او فقده لاي سبب، ان يتقدم للهينه بطلب الحصول علي تزخيص بدل تالف، او بدل فاقد، وذلك بعد تقدم جميع المستندات المطلوبه، وما يفيد سداد المقال المالي المستحق. العربيه ٢٧/٦ الهييه العامه للسياحه والتراث氧 والطفي Saudi Commission for Tourism & National Heritage الفصل الثالث التزامات المرخص له الماده الحاديه عشره: يتمز المرخص له بما يلي: - 1 التقيد - في ممارسته للنشاط المرخص به - بحدود الموقع محل الترخيص. -2 ممارسه النشاط المرخص به في المواعيد التي تحددها الهييه، وعدم اجراء اي تعديل في هذا الشان دون الحصول علي موافقه كتابيه مسبقه منها. - 3 - الالتزام بالبده بمارسه النشاط وانهاه خلال المواعيد التي تحددها الهييه. - 4 - التقيد بجميع الاشتراطات، والمعابير، والضوابط، والمتطلبات التي تحددها الهييه. - 5 - الالتزام بتنفيذ اي اشراط، او متطلب تراه الهييه بعد منح الترخيص. - 6 - ايلاغ الهييه باي تغيير يطرا علي المعلومات، والبيانات المقدمه منه للهييه في شان النشاط المرخص به، والمععداد والمرافق التي يستخدمها، وذلك خلال مده لا تتجاز خمسه عشر يوما من تاريخ حدوث هذا التغيير. - 7 - تزويد الهييه بجميع ما تطلبه من تقارير، او بيانات، او معلومات، او دراسات، او احصاءات تتعلق بالنشاط المرخص به. - 8 - عدم نشر اي معلومات، او بيان، او احصاء باي طريقه من طرق النشر الا بعد الحصول علي موافقه كتابيه صريحه من الهييه، وتنسق الهييه مع داره الملك عبدالعزيز قبل اصدار الموافقه فيما يتعلق بتاريخ المملكه الحديث. - 9 - تدوين نوع الترخيص الصادر له، ورقمه، وتاريخه، وذلك علي جميع وثايق تعاملاته مع الهييه. - 1 - وضع العلامات الارشاديه، والاتخديريه اللازمه، والالافتات الداله علي اسمه الشور النشاط المرخص به : داخل موقع الترخيص. الضارع ٢٢/٧ اللينه العامه للسياحه والتراثات الوطني Saudi Commission for Tourism & National Heritage - اتخاذ احتياطيات الامن، والصحه، والسلامه المهنيه للعاملين في موقع الترخيص. - ١٢- التقيد باشتراطات، ومتطلبات الجهات الحكوميه الاخري ذات العلاقه. - ١٣- التقيد باحكام نظام وجميع الانظمه، واللوايح الساريه في المملكه. - ١٤- الالتزام بالنظام العام، وعادات المجتمع، وتقافته، وتقاليده. التراثات المطلوبات الحضريات السماعيليه واللطيه السيد المطروح المنصانون for tourism & National العربيه ٢٦/٨ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الرابع تصنيف قطع العزاث الشعبي الماده الثانيه عشره: تشكل في القطاع بقرار من الرييس لجنه فنيه. لا يقل عدد اعضايها عن ثلاثه. من الخبراء والمتخصصين في مجال الاثار، تختص بتصنيف قطع التراث الشعبي. وفقا للفيات المنصوص عليها في الماده الرابعه والثلاثين من نظام، واطاء كل فيه رقما كوديا ثابتا، بحسب ما يقصي به دليل التصنيف، والترقيم الذي يعده القطاع، ويحدد القرار مقر عمل اللجنه، واليه مباشرتها لمهامها. الماده الثالثه عشره: -1 متحد اللجنه المشار اليها في الماده الثانيه عشره من هذه اللاتحه فيات التصنيف لقطع التراث الشعبي، وفقا لمدي توافر معيار، او اكثر مما يلي: المعيار التاريحي. ب- المعيار الفني والزخرفي. ج- المعيار الوطني. د- معيار الجوده. ه- معيار النده والتقرد. و - المعيار التقني. ز- معيار العوميه والخصوصيه. ح- معيار القيمه الماليه. ط- المعيار النوعي. - دون اخلل باحكام المواد الرابعه عشره، والخامسه عشره، والسادسه عشره من هذه اللاتحه، تضع اللجنه - لتحديد فيه التصنيف - النسبه الميويه التي يمثلها كل معيار من المعابير المنصوص عليها في الفقره (1) من هذه الماده. الفصل ٢٢/٩ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده الرابعه عشره: يجب لتصنيف قطع التراث الشعبي علي الفيه (ا). وهي فيه القطع ذات الاهميه العالميه. ان تتوافر فيها الاشتراطات التاليه: - ان يكون قد مضي علي صنعها مده لا تقل عن خمسه وثمانين عاما. - ان تكون دلاله قاطعه علي ما يشير الي نسبتها الي عصر بعينه، او الي واقعه تاريخيه، او الي شخصيه معروفه. ان تكون محافظه بجودتها، وصفاتها، وشكلها المميز. ان تكون علي درجه عاليه من الجوده والاتقان. ان تكون معرفه من حيث مصدرها، ومالكها، او حايزها، او محزرها، وذلك علي وجه -٥ القطع، واليقين، ويسند صحيح. -6 الا تكون مسروقه، او مختلصه، او مستولي عليها. -7 ان يكون قد سبق توثيقها، وتسجيلها بمعرفه الهييه. الماده الخامسه عشره: يجب لتصنيف قطع التراث الشعبي علي الفيه (ب) - وهي فيه القطع ذات الاهميه المتوسطه. ان تتوافر فيها الاشتراطات التاليه: - ان يكون قد مضي علي صنعها مده لا تقل عن سبعين عاما، او ان يكون قد مضي علي صنعها اكثر من ميه عام ; ولكن حالتها ردييه، او تعرضت للثقف، او الكسر بما لا يؤهل لتصنيفها علي الفيه (ا). - ان تكون منسويه الي زمن بعينه، او الي واقعه بعينها، او الي شخصيه تاريخيه مмиزه ومعروفه، او تدل علي حدث معروف. - ان تكون محفظه بجودتها، وصفاتها، وخصايصها التراثيه المميزه. - الا تكون مسروقه، او مختلصه، او مستولي عليها. - ان تكون معروفه من حيث مصدرها، ومالكها، او حايزها بسند رسمي صحيح. - ان يكون قد سبق توثيقها، وتسجيلها بمعرفه الهينه. الموزيه واللغه العربيه Visa President Office (ج) . وهي فيه القطع ذات الاهميه القليله . ان تتوافر فيها الاشتراطات التاليه: - ان يكون قد مضي علي صنعها اكثر من خمسين عاما، او ان يكون قد مضي علي صنعها مده اكثر من ذلك ; ولكن حالتها ردييه جدا، وتعرضت للطمس و-acتت اكثر معالمها وخصايصها، سواء اكان ذلك بفعل الطبيعه، او الانسان. - ان تكون معرفه المصدر، وال تاريخ، وتشير الي عصر معين، او واقعه تاريخيه محدده، او شخصيه معرفه، او حدث مشهور. - ان تكون محتفظه بجودتها، وحالتها، وخصايصها المميزه. - الا تكون مسروقه، او مختلفه، او مستولي عليها. - ان تكون معرفه المصدر من حيث مالكها، او حايزها. - ان يكون قد سبق توييها، وتسجيلها بمعرفه الهينه. الماده السابعه عشره: - علي مالك، او حايز قطعه التراث الشعبي المصنفه، عند فقدها او تلفها، او سرقتها، المبادره - خلال مده لا تتجاز سبعه ايام - الي ابلاغ القطاع، او اي من الادارات التابعه له في المملكه. - علي القطاع، او اي من الادارات التابعه له في المملكه - بعد ورود البلاغ - اجراء التحريات اللازمه للوقوف علي اسباب ققد او تلف او سرقه المطعه الصنفه، وتحديد المسؤول عنها، واعداد تقرير بذلك علي النموذج الذي الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الخامس مزادات بيع الاثار المنقوله وقطع التراث الشعبي الماده الثامنه عشره: تتولي الهينه وحدها الترخيص بتنظيم مزادات لبيع الاثار المنقوله، وقطع التراث الشعبي، وحدد المقابل المالي المستحق علي طالب الترخيص، وفقا ل قرار يصدر من الرييس. الماده التاسعه عشره: يلتزم المرخص له بتنظيم مزادات بيع الاثار المنقوله، وقطع التراث الشعبي - اضافه الي التزامه بما نصت عليه الماده (الحاديه عشره) من هذه اللاتحه - بما يلي: - امساك السجلات التي تقرها الهييه لهذا الغرض. - تقدم السجلات لمفتشي الهييه عند طلبها. - تزويد الهييه بصور جميع الاثار المنقوله، وقطع التراث الشعبي التي في حوزته. - وضع نسخه من الترخيص في مكان ظاهر في موقع المزاد. - تقدم حصر شهري للهييه بالاثار، والقطع التي تم بيعها، والمنقبيه لديه. - السما ح لمفتشي الهييه بدخول موقع المزاد، ومعاينته. - اتخاذ احتياطيات الامن، والصحه والسلامه داخل موقع المزاد. - فرز الاثار، والقطع النادره. التي سبق ان حددتها الهييه قبل بدء المزاد. عن غيرها. - عدم بيع، اشراء اي اثر منقول، او قطعه تراث شعبي الا بعد التحقق من شرعيه ملكيتها. -1. تزويد الهييه بفواتير بيع القطع النادره. الماده العشرون: علي كل مرخص له بتنظيم مزادات بيع الاثار المنقوله، وقطع التراث الشعبي؛ يغب في تنظيم مزاد، ايلاغ الهييه بذلك قبل تاريخ تنظيم المزاد بمده لا تقل عن ستين يوما ليوما يرفق المستندات التاليه: الخز ٢٢/١٢ الهييه العامه للسياحه والتراثات الوطني Saudi Commission for Tourism & National Heritage - 1 صوره الترخيص. - 2 صوره من اثبات هويته، او سجله التجاري. - 3 صوره لعقد ملكيه، او ايجار الموقع محل المزاد، او موافقه من مالك الموقع، او المنتفع به علي اقامه المزاد فيه. - 4 بيانا بالاثار المنقوله، وقطع التراث الشعبي التي ستعرض في المزاد، وصورا لها، وصورا لسندات ملكيتها. الماده الحاديه والعشرون: يجب ان تكون الاثار المنقوله وقطع التراث الشعبي المطلوب عرضها في المزاد مملوكه للمرخص له، او لاي من الاشخاص الذين يطرحون قطعهم في المزاد من خلاله، وذلك وفقا لاحكام النظام والاتفاقيات الدوليه المعنيه بالانجار بالتراث الثقافي التي تكون المملكه طرفا فيها. التراث المطلوبيه الاستعمال ٢٦/١٢ الهييه العامه للسياحه والتراث الوطنيه Saudi Commission for Tourism & National Heritage الفصل السادس تحاول الاثار المنقوله وقطع التراث الشعبي الماده الثانيه والعشرون: علي كل من يرغب في تداول اثر منقول، او قطعه تراث شعبي مملوك لاي شخص طبيعي، او اعتباري ان يثبت ملكيته لها بسند رسمي قاطع الدلاله. ويجب ان يكون الاثر، او القطعه قد سبق تسجيله لدي الهينه، وصدر ترخيص يسمح بتداوله. الماده الثالثه والعشرون: علي كل من يغف في نقل اثر منقول، او قطعه تراث شعبي يملكه بسند رسمي قاطع الدلاله من مكان الي اخر ان يحصل علي تصريح من الهينه. الماده الرابعه والعشرون: - اذا رغب مالك الاثر المنقول، او قطعه التراث الشعبي - المسجله في سجل الاثار بوصفها تراثا وطنيا - في تداولها باي وسيله من وسايل التداويل، فعليه التقيد بما يلي: - الحصول علي ترخيص من الهييه. - ان يكون التداول داخل حدود المملكه فقط. ج- عرض الاثر، او القطعه علي الهييه اولا اذا كان يربغ في بيعها. - ابلاغ من تنتقل اليه ملكيه الاثر، او القطعه بانها مسجله في سجل الاثار، و تزويده برقم تسجيلها في السجل. ه- ابلاغ من تنتقل اليه ملكيه الاثر، او القطعه باجراعات الحمايه المتخذه في شانها. و - انهاء الاجراءات اللازمه لنقل الملكيه. ز - ابلاغ الهييه - خلال مده لا تتجاوز ثلاثين يوما من تاريخ انهاء اجراءات نقل الملكيه - بتمام عمليه نقل الملكيه، وتزويدها باسم المالك الجديد، وبالمستندات التي تطلبها لاثبات ذلك. - تتولي الهييه التاشير في سجل الاثار بما يفيد نقل ملكيه الاثر المنقول، او قطعه التراث الشعبي، مع بيان اسم المالك الجديد، وسند الملكيه، وتاريخه. 27/14 الهييه العامه للسياحه والتراث الوطنيه Saudi Commission for Tourism & National Heritage الماده الخامسه والعشرون: - لا يجوز تداول اي اثر منقول، او قطعه تراث شعبي نقل من موقع اثري داخل المملكه. - لا يجوز تداول اي اثر منقول، او قطعه تراث شعبي نقل الي المملكه بطريقه غير نظاميه. الماده السادسه والعشرون: يجب علي كل من يغب في تداول قطعه اثريه تتوافر في شانها شروط التداول الصادره، وفق الماده الرابعه والعشرين من هذه اللاتحه ان يلترم في تداولها بجميع الاحكام التي نست عليها اتفاقيه منع الاتجار غير المشروع ونقل الممتلكات الثقافيه بطرق غير مشروعه واعادتها الي بلدها الاصلي الصادره عن منظمه الامم المتحده للتربيه والعلوم والثقافه. الماده السابعه والعشرون: يجوز تداول الاثار المنقوله التاليه في ضوء ما تحدده الهينه من ضوابط يتعين مراعاتها في التداول: - 1 العملات النقديه القديمه. - ٢ منتجات الفنون القديمه. - ٣ منتجات الفنون الاسلاميه. -٤ الاحافير. -٥ الصخور. -٦ الطوابع القديمه. ويجوز للهينه اضافه اي قطع اخري للتداو ل مستقبلا اذا رات ذلك بالاضوابط، والشروط التي يحددها الرييس بقرار يصدر منه. الماده الثامنه والعشرون: اذا رغبت الهينه في شراء الاثر المنقول، او قطعه التراث الشعبي المصنفه؛ فيقدر ثمنها بواسطه ثلاثه خبراء متمنين، علي ان يكون احمدهم من منسوبي الهينه، ويكون الاخران من المرخص لمهم وفقا لنظام المقيمين المعتمدين. 21/10 اللهمه العامه للسياحه والتراث الjcثني Saudi Commission for Tourism & National Heritage الفصل السابع النماذج الاثنيه الماده التاسعه والعشرون: 1 - الهينه هي صاحبه الحق الاصل في انتاج النماذج الاثريه، وعليها ان تضع ختم، او شعار الهينه علي تلك النماذج؛ لتمييرها عن غيرها. وللهينه الترخيص للاخص الطبيعيين، او الاعتبارين - من داخل المملكه، او خارجها - انتاج النماذج الاثريه، وفقا لاحكام نظام وهذه اللاتحه. - ٢- تخضع النماذج الاثريه، وصورها. التي تنتجها الهينه، او المزخص لمم بذلك. وكيفيه تداولها لحقوق الملكيه الفكريه، والعلامات التجاريه المنصوص عليها في الانظمه ذات الصله، وجميع الاتفاقيات، والمعاهدات الدوليه ذات العلاقه التي تكون المملكه طرفا فيها. الماده التلاثون: تستخدم في جميع عمليات انتاج النماذج الاثريه احدث الطرق العلميه والتقنيه الحديثه، وجميع المعدات والالات التي تساعد علي الانزقاء بهذا النشاط والنهوض به دون وقع اي اضرر علي القطع الاصليه نتيجه تاثيرات البيييه، وعوامل التعربيه التي يترتب عليها حدوث تغيرات في شكلها، او اوصافها، او جودتها، او الاقالل من قيمتها. الماده الحاديه والثلاثون: - 1 للهينه - دون غيرها - استثمار صور النماذج الاثريه في المجالين التجاري، والاعلامي; لترويج عن منتجاتها في هذا المجال. - 2 استثناء من الفقره (1) من هذه الماده، للهينه السماح لغيرها باستثمار صور النماذج الاثريه في المجالين التجاري، والاعلامي، وذلك بعد الحصول علي موافقه مسبقه منها. الفرخ ٢٢/١٦ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage -3 استثني من تطبيق احكام الفقرتين (1) من هذه الماده الحالات التي يقتصر فيها استخدام صور النماذج الاثرييه في حالات الاستخدام الشخصي، او لاغراض تعليميه، او ثقافيه، او لاغراض الترويج السياحي، من خلال الاجهزه الحكوميه. الماده الثانيه والثلاثون: 1. تضع الهييه الضوابط، والمواصفات والشروط الخاصه باستغلال صور الاثار المنقوله، وقطع التراث الشعبي كعلامات تجاريه خاصه بالهييه. ٢. للهينه الحق في الترخيص بانتهج النماذج الاثريه واستخداماتها بواسطه مؤسسات الانتاج الخاص وفق الاجراعات التاليه: ا/ تقديم تصاميم بمدنيه للنماذج المراد انتاجها مع طلب الترخيص. ب/ بعد موافقه، واعتماد الهينه للتصاميم النهاييه، يتم تسجيل تصاميم النماذج كعلامات تجاريه، وملكيه فكريه خاصه بالهينه. ج/ تصدر الهينه ترخيص انتاج النماذج الاثرييه للجهه المرخص لها، ولا يجوز تداول هذه النماذج تجاريا الا بعد فسحها بواسطه الهينه. الماده الثالثه والثلاثون: - 1 - نضع الهينه الضوابط، والمواصفات الخاصه بمناذج قطع التراث الشعبي المقلده للموروث السعودي التي يتم استيرادها من الخارج، وتصدر بقرار من الرييس، وتنشر في الجريده الرسميه. - 2 يحظر تداول، او دخول نماذج قطع التراث الشعبي التي صنعت بالمخالفه للضوابط والمواصفات المشار اليها في الفقره (1) من هذه الماده. ال Estimatesه للسياحه والتنميه Vise President Office Commission for Tourism & National Heritage العربيه ٢٢/١٧ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل الثامن استجيراد وتصدير القطع الاثربيه وقطع التتراث الشعبي الماده الربعه والثلاثون: يحظر علي اي شخص طبيعي، او اعتباري سعودي، او غير سعودي مزاوله اي نشاط يتعلق بعمليات استيراد، وتصدير القطع الاثربيه، او قطع التراث الشعبي دون الحصول علي ترخيص من الهينه، وثبوت ملكيته، وحيازته لها. ويجب علي من يرغب في مزاوله مهنه استيراد، او تصدير القطع الاثربيه، وقطع التراث الشعبي ان يتقدم بطلبه للهينه مرافقا له جميع المستندات المطلوبه، وما يفيد قيده في سجلات المصدرين، او المستوردين؛ وفقا للانظمه المعنيه بذلك. وتتولي الهينه. في حاله توافر الشروط المطلوبه في طالب الترخيص. اصدار الترخيص خلال تسعين يوما من تاريخ استيفاء جميع الاوراق، والمستندات المطلوبه. الماده الخامسه والثلاثون: يتولي القطاع اصدار الترخيض اللازم لموازله اعمال الاستيراد، والتصدير في حاله توافر الشروط اللازمه في طالبه. ويLTZM المرخص له باسماك سجلات معتمده من الهييه تخصص لقد ما في ملكبته، او حيازته من قطع التراث الشعبي، وبيان مصدرها واوصافها. الماده السادسه والثلاثون: لا يجوز مطلقا لاي شخص طبيعي، او اعتباري استيراد، او تصدير قطع التراث الشعبي الا وفقا للمعابير، والضوابط، والشروط التي ضعها الهييه. ولا يجوز تصدير القطع الاثریه التي استخرجت من اراضي المملكه، ونستثني من ذلك القطع الاثریه غير الموصوفه كتراث وطني بعد موافقه الهييه. الموزد والثروه هييه Politics & Music Vista President Office Vision for Tourism & National Heritage التحري ٢٢/١٨ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده السابعه والثلاثون: يجوز للهينه الترخيص بالتصدير في الحالات الاتيه: - اذا كانت القطع المطلوب تصديرها ستشارك بها المملكه في المعارض، والمحافل، والمتاحف الدوليه علي ان تعاد مره اخري بعد انتها المهمه التي صدرت من اجلها. - اذا كان تصدير القطع الاثرييه، وقطع التراث الشعبي يهدف الي مبادلتها بقطع اخري لدي المتاحف، والهينات الاجنبيه من اجل اثراء النشاط الثقافي السعودي وازدهاره. - اذا كانت القطع المطلوب تصديرها سبق تخصيصها بمعرفه الهينه لاحدي البعثات العلاميه نتيجه اجراء حفاير، او تنقيب اثري. - اذا كانت القطع المطلوب تصديرها قد واقفت الهينه علي اعارتها اعاره مؤقته لاحدي البعثات العلميه، او الدول الاجنبيه، او العربيه لاجراء الدراسات، والابحاث بصددها. الماده الثامنه والثلاثون: يجب علي المرخص له اعداد بيان بالقطع الاثريه، وقطع التراث الشعبي توافق عليه الهينه، وعليه وضع هذه القطع داخل صناديق مغلقه من اجل حمايتها، ويتم تجميعها واغلقها بالشمع الاحمر بخاتم الهينه. الماده التاسعه والثلاثون: يتعين ان تكون النماذج والقطع الاثريه وقطع التراث الشعبي التي يتم استيرادها من خارج المملكه غير مطابقه لمواصفات الاثر الاصلي دراء للتشابه والاختلاط والtzييف. للمواصفات القياسيه التي تراها الهييه في هذا الصدد، كما تصدر الهييه الموافقه علي الفسح علي النماذج والقطع بعد التاكد من مطابقتها للمواصفات التي اصدرتها الهييه. المواقبيه للسياحه والتنميه Vice President Office Saudi Commission for Tourism & National Parks الفرق ٢٢/٩ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الفصل التاسع ايقاف النشاط او تعليق الترخيص او اعفاؤه الماده الاربعون: - دون الاخلال باي عقوبه نظاميه، للجنه المنصوص عليها في الماده التسعين من النظام، للنظر في صدور قرار منها اييقاف نشاط الاطار بالاثار المنفوله، او قطع التراث الشعبي، او تعليقه، او الغاثه، وذلك في اي من الحالات التاليه: - اذا ثبت تقدمي المخص له اوراقا مؤوره في سبيل الحصول علي الترخيص. ب - اذا ثبت تقدمي المخص له - في طلبه، او في الاقرارات، او المستندات المقدمه منه - لبيانات، او معلومات كاذبه، او مصلله. ج- اذا فقد المخص له احد اشتراطات، او متطلبات الترخيص، ولم يقم بënصحيح وضعه خلال المده التي تحددها الهينه. - اذا تتازل عن الترخيص للغير - كليه، او جزييه - دون موافقه مسبقه من الهينه. ه - اذا قام بënصنيع نماذج لم توافق عليها الهينه، او مخالفه للمواصفات التي اشترطتها الهينه. و - اذا ثبت ان في استمرار النشاط المزخص به خطوره علي الامن، او الصحه العامه، او البييه، او السلامه. - اذا صدرت في حق المزخص له ثلاث قرارات بايقاف النشاط او تعليق الترخيص خلال سنه واحده. - اذا صدر بحق المزخص له حكم نهايي في اي من الجرايم المنصوص عليها في النظام. - اذا ارتكب المزخص له فعلا يستوجب ايقاف النشاط، او تعليق الترخيص، او الغاء غير الافعال المنصوص عليها في هذه الماده من هذه اللاتحه. السماع ٢٢/٢٠ الهييه العامه للسياحه والتراث الوطني Saudi Commission for Tourism & National Heritage الماده الحاديه والاربعون: في حاله صدور قرار من اللجنه بايقاف النشاط، او تعليق الترخيص، فيجب الا تتجاز مده الايقاف، او التعليق سنه اشهر. الماده الثانيه والاربعون: علي الهييه، عند صدور
